2011年第 1期 法律科學(xué) 西北政法大學(xué)學(xué)報(bào) 71 : 1674 - 5205 2011 010071 013 論國(guó)際法的財(cái)產(chǎn)權(quán)邏輯 蔡從燕 廈 門大學(xué)法學(xué)院, 福建 廈 門 361005 財(cái)產(chǎn)權(quán)與主權(quán)的關(guān)系、財(cái)產(chǎn)權(quán)與國(guó)際和平及發(fā)展的關(guān)系、全球化背景下國(guó)際法實(shí)踐的基本趨勢(shì), 以 及財(cái)產(chǎn)權(quán)內(nèi)涵的 定性都表明, 在理解國(guó)際法方面, 財(cái)產(chǎn)權(quán)邏輯可以構(gòu)成傳統(tǒng)主權(quán)邏輯之外的另 一進(jìn)路。迄今為 止, 國(guó)際法的財(cái)產(chǎn)權(quán)邏輯在權(quán)利主體、規(guī)制標(biāo)準(zhǔn)以及保護(hù)手段方面發(fā)生了重要變化, 而在財(cái)產(chǎn)權(quán)觀念方面并未發(fā)生 明顯變化, 這對(duì)于以往以及未來(lái)的國(guó)際和平與發(fā)展都具有重要的影響。財(cái)產(chǎn)權(quán)邏輯的進(jìn)路促使人們認(rèn)識(shí)到國(guó)際法 實(shí)踐在主權(quán)之外還存在著或許更為綿長(zhǎng)的動(dòng)力, 即財(cái)產(chǎn)權(quán), 從而有助于國(guó)際社會(huì)借鑒國(guó)內(nèi)成熟的財(cái)產(chǎn)權(quán)法律經(jīng)驗(yàn), 以國(guó)際法基本宗旨為基本依據(jù), 解構(gòu)并重構(gòu)現(xiàn)行國(guó)際法財(cái)產(chǎn)權(quán)邏輯, 以切實(shí)實(shí)現(xiàn)并長(zhǎng)期維護(hù)國(guó)際和平與發(fā)展, 進(jìn)而 推動(dòng)國(guó)際法治。 國(guó)際法; 財(cái)產(chǎn)權(quán); 國(guó)際和平與安全; 發(fā)展 A bstract: The re la tionsh ip e wt een property r ights and sove re ignty, property rights and internationa l peace and deve l opm ent, fundam enta l trend o f interna tiona l law in the g lo a liza tion, and the certa inty of the m ean ing o f property r ights de v ise the property r ights another approach to understanding interna tiona l law esides the sov ere ignty approach.
