2011年第 1期 法律科學(xué) 西北政法大學(xué)學(xué)報 71 : 1674 - 5205 2011 010071 013 論國際法的財產(chǎn)權(quán)邏輯 蔡從燕 廈 門大學(xué)法學(xué)院, 福建 廈 門 361005 財產(chǎn)權(quán)與主權(quán)的關(guān)系、財產(chǎn)權(quán)與國際和平及發(fā)展的關(guān)系、全球化背景下國際法實踐的基本趨勢, 以 及財產(chǎn)權(quán)內(nèi)涵的 定性都表明, 在理解國際法方面, 財產(chǎn)權(quán)邏輯可以構(gòu)成傳統(tǒng)主權(quán)邏輯之外的另 一進路。迄今為 止, 國際法的財產(chǎn)權(quán)邏輯在權(quán)利主體、規(guī)制標準以及保護手段方面發(fā)生了重要變化, 而在財產(chǎn)權(quán)觀念方面并未發(fā)生 明顯變化, 這對于以往以及未來的國際和平與發(fā)展都具有重要的影響。財產(chǎn)權(quán)邏輯的進路促使人們認識到國際法 實踐在主權(quán)之外還存在著或許更為綿長的動力, 即財產(chǎn)權(quán), 從而有助于國際社會借鑒國內(nèi)成熟的財產(chǎn)權(quán)法律經(jīng)驗, 以國際法基本宗旨為基本依據(jù), 解構(gòu)并重構(gòu)現(xiàn)行國際法財產(chǎn)權(quán)邏輯, 以切實實現(xiàn)并長期維護國際和平與發(fā)展, 進而 推動國際法治。 國際法; 財產(chǎn)權(quán); 國際和平與安全; 發(fā)展 A bstract: The re la tionsh ip e wt een property r ights and sove re ignty, property rights and internationa l peace and deve l opm ent, fundam enta l trend o f interna tiona l law in the g lo a liza tion, and the certa inty of the m ean ing o f property r ights de v ise the property r ights another approach to understanding interna tiona l law esides the sov ere ignty approach.
