【摘要】：長(zhǎng)期以來,世界許多國(guó)家將信用證作為一種重要的國(guó)際貿(mào)易支付方式,跟單信用證統(tǒng)一慣例(UCP)明確了信用證相關(guān)當(dāng)事人的權(quán)利、義務(wù)和責(zé)任,也被廣泛接受適用。作為最新版本UCP600,較之使用了十多年的UCP500有了許多新的發(fā)展,本文主要通過將UCP600與UCP500進(jìn)行對(duì)比,概述了UCP600較之UCP500幾個(gè)相對(duì)重要的改動(dòng),如“相符交單”的審單規(guī)定,不僅從UCP600規(guī)定本身分析了“相符”的涵義、信用證審單相符的規(guī)定,而且根據(jù)實(shí)踐情況探討了“不相符”的情形以及在這種情況下怎樣處理等內(nèi)容;又如“議付”規(guī)定的變動(dòng)和“不可撤銷信用證”的規(guī)定等。 從對(duì)UCP600規(guī)則條文本身的分析,本文探索了在現(xiàn)實(shí)國(guó)際貿(mào)易交易過程中對(duì)信用證受益人的有利有弊之處以及通過我國(guó)一則最高人民法院的案例闡述了UCP600在我國(guó)的應(yīng)用。除此之外,還分析了其他一些需要信用證受益人在具體實(shí)踐中引起注意的事項(xiàng),從而得出對(duì)信用證受益人在適用UCP600時(shí)的一些法律建議來避免法律風(fēng)險(xiǎn)。
[Abstract]:For a long time, many countries in the world regard letter of credit as an important way of payment for international trade. (UCP) defines the rights, obligations and responsibilities of the parties to the letter of credit, and is also widely accepted and applied. As the latest version of UCP600, has many new developments compared with UCP500, which has been in use for more than ten years, this paper mainly compares UCP600 with UCP500, and summarizes several relatively important changes of UCP600 compared with UCP500, such as the order regulation of "conformance with submission". This paper not only analyzes the meaning of "conformity" and the stipulation of conformity of L / C review documents from the perspective of UCP600 regulation itself, but also probes into the situation of "inconsistency" according to the practical situation and how to deal with it in this case. Such as the "negotiation" provisions of the changes and "irrevocable letter of credit" provisions, and so on. Based on the analysis of the provisions of UCP600 rules, this paper explores the advantages and disadvantages of the beneficiaries of letters of credit in the process of real international trade transactions, and expounds the application of UCP600 in China through a case of the Supreme people's Court of China. In addition, this paper also analyzes some other matters that need to be paid attention to in the concrete practice of the beneficiary of the letter of credit, and obtains some legal suggestions for the beneficiary of the letter of credit when applying UCP600 to avoid the legal risk.
