歐盟反傾銷法公共利益條款研究

【摘要】:反傾銷措施是世貿(mào)組織給予各成員方應對外國產(chǎn)品低價沖擊的一種合法有效手段。根據(jù)世貿(mào)組織《反傾銷協(xié)議》的規(guī)定,當世貿(mào)組織成員方國內(nèi)產(chǎn)業(yè)受到傾銷產(chǎn)品沖擊造成國內(nèi)產(chǎn)業(yè)損害、損害威脅或對建立相關產(chǎn)業(yè)造成實質阻礙時,成員方可以對傾銷產(chǎn)品實施以征收反傾銷稅為代表的反傾銷措施。反傾銷措施有力的回應了外國產(chǎn)品對本國市場的低價沖擊,降低了進口產(chǎn)品本國相關產(chǎn)業(yè)發(fā)展的威脅,為本國市場及其產(chǎn)業(yè)提供了切實有效的保護。 反傾銷法中公共利益條款的設置試圖通過對各種利益的比較得出最優(yōu)的決策方案。世貿(mào)組織及其成員方特別是歐共體(歐盟)的反傾銷立法中均可以發(fā)現(xiàn)公共利益條款的身影。而歐盟在進行反傾銷調(diào)查中有專門的法律規(guī)范進行公共利益審查,詳實的法律依據(jù)、完善的法律程序對全面評估公共利益并以評估的結果作為反傾銷措施的依據(jù)值得我們學習。盡管在我國的反傾銷法律中也有公共利益條款的規(guī)定,但其太過寬泛缺乏操作性,同時在我國對外貿(mào)易往來中針對我國產(chǎn)品發(fā)起的反傾銷調(diào)查甚囂塵上,如何應對外國傾銷產(chǎn)品對我國的沖擊,以及怎樣應對外國對我國出口產(chǎn)品的反傾銷措施,是當今全球化背景下擺在我國面前的一個課題。有鑒于此,本論文試圖通過分析歐共體(歐盟)在反傾銷立法及實踐中對公共利益的規(guī)定和運用,構建我國自主的反傾銷公共利益條款,同時通過比較分析,也為我國應對國外針對我國產(chǎn)品的反傾銷措施提供些許建議。 本文除引言和結語外共分為四個部分。 第一部分“反傾銷法中規(guī)定公共利益條款的必要性”,本部分著重分析反傾銷法在保護國內(nèi)產(chǎn)業(yè)利益方面的積極作用與反傾銷法本身體現(xiàn)出的不足,并指出國家整體利益最大化應是反傾銷立法及實踐的出發(fā)點和歸宿,闡明在反傾銷立法及實踐中進行公共利益評估的必要性。 第二部分“歐盟反傾銷法中有關公共利益問題的實體因素”,本部分詳細分析歐盟在反傾銷立法及實踐中關于公共利益的實體規(guī)定,以典型案例如歐盟硅鐵復審案作為支撐闡述歐盟反傾銷立法及實踐中如何確定產(chǎn)品市場與競爭結構,怎樣評估采取的反傾銷措施對各利益關聯(lián)方如歐盟產(chǎn)業(yè)、產(chǎn)品的下游用戶、產(chǎn)品進口商及最終消費者的利益影響以及對市場競爭結構可能產(chǎn)生的影響,并根據(jù)這些評估作為最終決定征收反傾銷稅的依據(jù)。 第三部分“歐盟反傾銷法中有關公共利益問題的程序設計”,重在分析歐盟反傾銷立法及實踐中進行公共利益調(diào)查的程序規(guī)定,本部分突出強調(diào)了歐盟公共利益審查中利益關聯(lián)方的確定及這些利益關聯(lián)方所享有的程序性權利以及進行公共利益審查的具體情形。 第四部分“歐盟反傾銷法中公共利益條款對我國反傾銷立法及實踐的借鑒”,本部分首先分析了我國在反傾銷立法及實踐中公共利益方面存在的不足,提出借鑒歐盟在公共利益立法及實踐方面的成熟經(jīng)驗來完善我國反傾銷法的建議,同時我國在對外反傾銷實踐中也應加強對公共利益方面的審查,努力做到國家整體利益、長遠利益的最大化。
[Abstract]:Anti-dumping measures are a legitimate and effective means given by the WTO to the low price shocks of foreign products. According to the WTO < Anti-dumping Agreement >, when the domestic industries of WTO members are affected by the impact of the dumping products, the threat of damage or the substantial obstacles to the establishment of the related industries, the WTO members will have a substantial impediment to the establishment of the related industries. The anti dumping measures can effectively respond to the low price impact of foreign products on the domestic market, reduce the threat to the development of domestic related industries and provide effective protection for the domestic market and its industry.
The provision of public interest in the anti dumping law tries to get the best decision by comparing various interests. The WTO and its members, especially the European Community (EU), can find the figure of the public interest clause in the anti-dumping legislation of the European Community (EU). The EU has a special legal norm for public interest in the anti-dumping investigation. It is worth learning for us to learn from the benefit review, the detailed legal basis and the perfect legal procedure for comprehensive assessment of the public interest and the results of the evaluation as an antidumping measure. Although there are also the provisions of the public interest clause in our anti-dumping law, it is too broad and lacking in exercise, at the same time, it is aimed at me in the foreign trade of our country. The anti-dumping investigation launched by the national products is very crowded. How to deal with the impact of foreign dumping products on our country and how to deal with the anti-dumping measures of foreign products to our country are a subject facing our country in the background of globalization today. In practice, the provisions and applications of public interests are used to build our own anti dumping public interest clauses. At the same time, through comparative analysis, some suggestions are provided for our country to deal with anti-dumping measures against China's products abroad.
In addition to the introduction and conclusion, this article is divided into four parts.
The first part, "the necessity of the provision of public interest in the antidumping law", this part focuses on the analysis of the positive role of the antidumping law in protecting the domestic industrial interests and the shortcomings of the anti-dumping law itself, and points out that the maximum of the country's overall interests should be the starting point and the end of the anti-dumping legislation and practice, and clarifies the Antidumping of the anti-dumping law. The necessity of public interest assessment in legislation and practice.
The second part is "the entity factor of the issue of public interest in the EU anti-dumping law". This part analyzes the substantive provisions concerning the public interests in the anti-dumping legislation and practice in the EU. The typical case, such as the EU ferrosilicon complex review, illustrates how to determine the product market and competition structure in the EU anti-dumping legislation and practice. How to assess the impact of anti-dumping measures on interest related parties such as the EU industry, downstream users of products, product importers and final consumers, as well as the possible impact on the market competition structure, and based on these assessments as the basis for the final decision to levy anti-dumping duties.
The third part, "the procedural design of the issue of public interest in the EU anti-dumping law", focuses on the procedural provisions of the investigation of public interests in the EU anti-dumping legislation and practice. This part highlights the determination of the interest related parties in the EU public interest review and the procedural rights enjoyed by these interest related parties and the progress of the EU's public interest review. The specific circumstances of the review of public interest.
The fourth part is "the reference of the public interest clause in the EU anti dumping law on our anti-dumping legislation and practice". This part first analyzes the shortcomings of our country's public interests in the anti-dumping legislation and practice, and proposes to draw on the European Union's mature experience in the public interest legislation and practice to improve our anti-dumping law. At the same time, China should strengthen the examination of public interest in the practice of foreign anti-dumping, and strive to maximize the overall interests of the country and the long-term interests.
