【摘要】：目前縱觀現(xiàn)今北極主權(quán)問題的日益突出,各國對北極的爭奪日益激烈的同時,北極以一個冰冷的地方,從無人問津到如今引起全球重點的關(guān)注,所遭到的生態(tài)環(huán)境保護的問題也是不容全人類的忽視。一方面,北極有豐富的自然資源及其重要的戰(zhàn)略地位；另一方面北極脆弱的生態(tài)環(huán)境系統(tǒng)之保護問題應(yīng)當引起高度關(guān)注,北極生態(tài)環(huán)境保護的法律制度也亟待完善。 鑒于此,本論文將從以下四個方面闡述完善北極生態(tài)環(huán)境保護法律的必要性： 第一部分主要介紹了北極區(qū)域生態(tài)環(huán)境系統(tǒng)的變化以及對全球的影響,包括北極地區(qū)碳循環(huán)和海洋生態(tài)環(huán)境系統(tǒng)所遭遇的變化。并提出了相關(guān)的由北極氣候變化所引發(fā)出的相關(guān)法律問題,并簡要分析了北極生態(tài)環(huán)境問題的原因,從而為下一步的闡述做好鋪墊。 第二部分分別從現(xiàn)有國際條約中與北極生態(tài)環(huán)境保護有關(guān)的法律制度、直接涉及北極國際條約以及文件中關(guān)于生態(tài)環(huán)境保護的內(nèi)容、北極八國國內(nèi)法中關(guān)于生態(tài)環(huán)境保護的規(guī)定來分析以及從歐盟北極政策中對北極生態(tài)環(huán)境保護的潛在影響,表現(xiàn)出北極在這方面法律上亟待完善的現(xiàn)實情況。 第三部分從與北極生態(tài)環(huán)境保護有關(guān)的法律沖突問題著手,剖析在北極生態(tài)環(huán)境保護法律問題中傳統(tǒng)條約沖突解決方法的局限性。并把國際法的不成體系性作為切入點來剖析與解決北極生態(tài)環(huán)境保護法律沖突的新思路,從而提出北極與生態(tài)環(huán)境保護相關(guān)法律沖突的解決構(gòu)想。 第四部分針對北極日益嚴重的生態(tài)問題提出自己關(guān)于北極生態(tài)環(huán)境保護法律實施路徑的建議,具體包括對北極生態(tài)環(huán)境保護法律的實施框架、實施機構(gòu)和資金來源的設(shè)想建議。 北極擁有大量的自然資源,其絕佳的地理優(yōu)勢,可以方便航行,對于可能帶來的巨大的經(jīng)濟利益和科研的價值,以及其所擁有的非凡軍事戰(zhàn)略意義更使其被各國激烈的爭奪。但是更為緊要的是北極地區(qū)生態(tài)環(huán)境的保護,對于全球都是一個亟須重視的問題,所以對于北極生態(tài)環(huán)境保護法律的完善也是迫在眉睫的。
[Abstract]:At present, as the issue of Arctic sovereignty becomes increasingly prominent, the competition for the Arctic is becoming increasingly fierce. At the same time, the Arctic, in a cold place, has attracted global attention from no one to now. The problem of ecological environment protection is not to be ignored by all mankind. On the one hand, the Arctic has abundant natural resources and its important strategic position; on the other hand, the protection of the fragile ecological environment system in the Arctic should be highly concerned, and the legal system of the Arctic ecological environment protection should be urgently improved. In view of this, this paper will expound the necessity of perfecting the law of Arctic ecological environment protection from the following four aspects: The first part mainly introduces the changes of the ecological environment system in the Arctic region and its impacts on the whole world, including the carbon cycle in the Arctic region and the changes encountered by the marine ecological system. The related legal problems caused by Arctic climate change are put forward, and the reasons of Arctic ecological environmental problems are briefly analyzed, thus laying the groundwork for the further elaboration. The second part deals with the legal system related to the protection of the Arctic ecological environment from the existing international treaties, directly related to the Arctic international treaties and the contents of the documents on the protection of the ecological environment. Based on the analysis of the regulations on ecological environment protection in the eight Arctic countries and the potential impact of EU Arctic policy on the protection of the Arctic ecological environment, it shows that the Arctic needs to be perfected in this aspect of law. The third part analyzes the limitation of traditional treaty conflict in the legal problems of Arctic ecological environment protection from the point of view of the conflict of laws related to the protection of the Arctic ecological environment. Taking the fragmentation of international law as the starting point to analyze and resolve the legal conflict of ecological environment protection in the Arctic, this paper puts forward the idea of resolving the legal conflict between the Arctic and ecological environment protection. The fourth part puts forward some suggestions on the implementation path of Arctic ecological environment protection law in view of the increasingly serious ecological problems in the Arctic, including the framework of the implementation of the Arctic ecological environment protection law, the implementing agency and the source of funds. The Arctic has a large number of natural resources, its excellent geographical advantages, can facilitate navigation, the potential for the enormous economic benefits and scientific research value, as well as the extraordinary military strategic significance of its own, it has been fierce competition among countries. But what is more important is the protection of the ecological environment in the Arctic, which is an urgent problem for the whole world, so it is urgent to perfect the law of the protection of the ecological environment of the Arctic.
