【摘要】：馬克思主義國際法思想是一個系統(tǒng)體系,包括馬克思恩格斯國際法思想、列寧國際法思想和中國化馬克思主義國際法思想。馬克思恩格斯國際法思想的產(chǎn)生和發(fā)展有其國際經(jīng)濟基礎(chǔ)、國際政治基礎(chǔ)和思想基礎(chǔ),它的出發(fā)點和最終目的是為世界無產(chǎn)階級暴力推翻資產(chǎn)階級統(tǒng)治提供國際合法依據(jù),進而為建立無產(chǎn)階級專政國家、促使人類共同邁入共產(chǎn)主義社會、實現(xiàn)永久和平提供動力支持。馬克思恩格斯運用階級分析法和經(jīng)濟分析法,揭示了近代國際法產(chǎn)生和發(fā)展趨勢,他們提出的人權(quán)思想、民族平等觀念、戰(zhàn)爭法思想等,至今都還具有重要的理論意義和實踐價值。列寧繼承和發(fā)展了馬克思恩格斯的國際法思想,指出帝國主義是現(xiàn)代戰(zhàn)爭的根源,提出了民族自決原則,認為社會主義國家與資本主義國家可以和平共處等國際法思想。這些國際法思想的提出和發(fā)展,不僅為新生的蘇維埃政權(quán)爭取到了和平的國際環(huán)境,從而能集中精力進行社會主義建設(shè),而且也為前蘇聯(lián)對外關(guān)系的開展提供了國際法理論指導(dǎo)。以列寧國際法思想為理論指導(dǎo)的蘇聯(lián)社會主義國家的建立,標志著國際法已從近代國際法的發(fā)展階段進入了現(xiàn)代國際法的發(fā)展階段。列寧提出的一系列國際法思想,奠定了現(xiàn)代國際法的思想理論基礎(chǔ)。列寧的國際法思想,在馬克思主義國際法思想的發(fā)展過程中起到了承上啟下的作用。馬克思主義傳入中國后,杰出的中國馬克思主義者繼承和吸收了馬克思、恩格斯、列寧的國際法思想,并緊扣時代主題,洞悉國際情勢,提出了和平共處五項基本原則以及擱置爭議、共同開發(fā)等諸多國際法思想,為中國爭取到了和平的國際環(huán)境,保障了我國社會主義建設(shè)的有序進行,同時也為國際關(guān)系民主化和和諧世界的構(gòu)建提供了國際法理論基礎(chǔ)。目前,經(jīng)濟全球化已成為不可逆轉(zhuǎn)的時代潮流,經(jīng)濟一體化也加速了國內(nèi)規(guī)則與國際規(guī)則的趨同,這既為馬克思主義國際法思想的發(fā)展提供了新機遇,但也帶來了巨大的挑戰(zhàn)。在面對著西方國家在國際法領(lǐng)域中的壟斷性地位,作為社會主義國家的中國,如何充分研究并運用馬克思主義國際法思想理論,提高我國在國際法領(lǐng)域中的發(fā)聲,這是我國發(fā)展馬克思主義國際法思想應(yīng)首先思考的問題�；�于此,我國應(yīng)首先梳理馬克思主義國際法思想發(fā)展的歷程及各個階段的特點,總結(jié)馬克思主義國際法思想歷史發(fā)展過程中的經(jīng)驗和教訓(xùn),并結(jié)合當代國際政治經(jīng)濟關(guān)系發(fā)展的新特點,科學(xué)地發(fā)展馬克思主義國際法思想,這不僅能為和諧世界的構(gòu)建提供現(xiàn)實的國際法思想指導(dǎo),也能為我國進一步融入國際社會和發(fā)揮我國在國際事務(wù)中的作用提供國際法思想支持,進而為中國和平崛起、民族復(fù)興提供國際法思想支撐。
[Abstract]:Marxist thought of international law is a systematic system, including Marx and Engels' thought of international law, Lenin's thought of international law and Sinicization of Marxist thought of international law. The emergence and development of Marx and Engels' thought of international law has its international economic foundation, international political basis and ideological basis, and its starting point and ultimate aim is to provide the international legal basis for the world proletariat to overthrow the bourgeois rule by force. Then it provides motive support for the establishment of proletarian dictatorship, the common entry of mankind into communist society and the realization of permanent peace. Marx and Engels used class analysis and economic analysis to reveal the emergence and development trend of modern international law, their ideas of human rights, the concept of national equality, the law of war, etc. Up to now, it still has important theoretical significance and practical value. Lenin inherited and developed Marx and Engels' thought of international law, pointed out that imperialism was the root of modern war, put forward the principle of national self-determination, and thought that socialist countries and capitalist countries could coexist peacefully in international law. The introduction and development of these ideas of international law not only won a peaceful international environment for the nascent Soviet regime, but also enabled them to concentrate on socialist construction. It also provides the theoretical guidance of international law for the development of the former Soviet Union's foreign relations. The establishment of the Soviet Socialist country guided by Lenin's thought of international law indicates that international law has moved from the development stage of modern international law to the development stage of modern international law. Lenin put forward a series of ideas of international law, laid the ideological and theoretical foundation of modern international law. Lenin's thought of international law played an important role in the development of Marxist thought of international law. After Marxism was introduced into China, the outstanding Chinese Marxists inherited and absorbed Marx, Engels and Lenin's thought of international law, and closely followed the theme of the times to understand the international situation. He put forward the five basic principles of peaceful coexistence, put aside disputes, and jointly developed many international laws, which won China a peaceful international environment and ensured the orderly progress of China's socialist construction. It also provides the theoretical basis of international law for the democratization of international relations and the construction of a harmonious world. At present, economic globalization has become an irreversible trend of the times, economic integration has also accelerated the convergence of domestic and international rules, which not only provides a new opportunity for the development of Marxist thought of international law, but also brings great challenges. In the face of the monopoly status of western countries in the field of international law, as a socialist country, how to fully study and apply Marxist international law theory to improve the voice of our country in the field of international law, This is the question that our country develops Marxism international law thought should think first. Based on this, our country should first comb the history and characteristics of the development of Marxist international law thought, sum up the experience and lessons in the historical development of Marxist international law thought. Combined with the new characteristics of the development of contemporary international political and economic relations, the scientific development of Marxist thought of international law, which can not only provide a realistic guidance of international law for the construction of a harmonious world. It can also provide the ideological support of international law for our country to further integrate into the international community and give play to our country's role in international affairs, and then provide the ideological support of international law for China's peaceful rise and national rejuvenation.
