【摘要】：作為政策性金融工具的一種,官方支持的出口信貸一方面對于提供國的出口貿(mào)易和國民經(jīng)濟(jì)的發(fā)展具有重要的作用,另一方面又對國際貿(mào)易有一定的扭曲作用。為了防止各國的出口信貸政策之間形成惡性競爭,維護(hù)國際貿(mào)易的經(jīng)濟(jì)秩序,OECD制定了《OECD關(guān)于官方支持出口信貸指導(dǎo)原則的安排》,WTO《補貼與反補貼措施協(xié)定》將該“君子協(xié)定”引入WTO體系中,官方支持的出口信貸可能會成為禁止性補貼或可訴補貼而受到WTO的規(guī)制。 本文主要目地是分析官方支持的出口信貸與WTO法規(guī),尤其《補貼語與反補貼措施協(xié)定》的合規(guī)性,通過對WTO補貼與反補貼協(xié)定和OECD的“君子協(xié)定”有關(guān)出口信貸的規(guī)定的分析,結(jié)合WTO爭端解決機(jī)制有關(guān)官方出口信貸案例的研究,試圖澄清WTO規(guī)則中有關(guān)出口信貸規(guī)定的含義,研究其在具體適用中可能產(chǎn)生的法律問題。我國通過出口信貸對某些產(chǎn)業(yè)、產(chǎn)品的出口支持可能觸及了其他WTO成員方的利益,一些WTO成員方可能根據(jù)有關(guān)反補貼規(guī)則向WTO爭端解決機(jī)制提出有關(guān)中國官方支持的出口信貸措施申訴。本文最后結(jié)合中國的出口信貸政策分析歐、美對中國出口信貸措施可能的指控,進(jìn)行中國有關(guān)措施的合規(guī)性分析,并提出完善我國出口信貸措施的建議。
[Abstract]:As a kind of policy-oriented financial instrument, export credit supported by the government plays an important role in the export trade and the development of the national economy of the supplying country on the one hand, and distorts the international trade on the other. In order to prevent vicious competition among national export credit policies, To safeguard the economic order of international trade, the OECD has formulated an arrangement on the guiding principles of official support for Export Credit. The Agreement on subsidies and countervailing measures has introduced the Agreement into the WTO system. Officially-backed export credits may be regulated by WTO as prohibited subsidies or actionable subsidies. The main purpose of this paper is to analyze the compliance of export credit and WTO regulations supported by the government, especially the Agreement on subsidies and countervailing measures, through the analysis of the provisions of the Agreement on subsidies and countervailing measures of WTO and the Agreement on Export Credit of OECD. Based on the case study of official export credit in WTO dispute settlement mechanism, this paper attempts to clarify the meaning of export credit regulation in WTO rules and to study the legal problems that may arise in its application. China's export support for certain industries and products through export credit may have touched the interests of other WTO members. Some WTO members may file complaints about China's state-backed export credit measures to the WTO dispute settlement mechanism under the countervailing rules. In the end, this paper analyzes the possible allegations of China's export credit measures from Europe and the United States, and makes an analysis of the compliance of China's relevant measures, and puts forward some suggestions for perfecting China's export credit measures.
