【摘要】：正司法實踐中,犯罪嫌疑人、被告人負(fù)案在逃增加了偵查工作難度,特別是在被害人死亡案件中的證據(jù)問題更為突出。據(jù)統(tǒng)計,2011年某市公安機(jī)關(guān)在清理積案工作中共抓獲逃犯1373人,其中,被害人死亡案件逃犯97件105人。在被害人死亡案件中,最早的發(fā)生于1986年,其中,涉嫌故意殺人犯罪案件75人,故意傷害(致死)犯罪案件28人,搶劫致人死亡案件1案1人,綁架致人死亡1案1人。截至2012年4月,有74人移送審查起訴,經(jīng)審查,符合"事實清楚,證據(jù)確實、充分"的案件13人;證據(jù)存在瑕疵,但符合"兩個基本"
