On the Translation of Litigation Documents with Foreign Elem

隨著全球化進(jìn)程和中國(guó)改革開(kāi)放進(jìn)程不斷深入,中外法律文化的交流也呈現(xiàn)出蓬勃發(fā)展的態(tài)勢(shì)。法律翻譯的重要性和緊迫性不言而喻。訴訟文書(shū),作為一國(guó)法律的重要載體,明確了當(dāng)事人的權(quán)利義務(wù)關(guān)系,體現(xiàn)了公正司法、維護(hù)社會(huì)公平正義的宗旨。當(dāng)前,學(xué)界對(duì)涉外訴訟文書(shū)翻譯的研究尚未形成專(zhuān)門(mén)系統(tǒng)的理論體系,而實(shí)踐中涉外訴訟文書(shū)的翻譯更是參差不齊,謬誤百出。有專(zhuān)家指出,法律文本翻譯的研究水平遠(yuǎn)落后于文學(xué)翻譯和科技翻譯等領(lǐng)域的研究水平。但是值得一提的是,韓禮德提出的系統(tǒng)功能語(yǔ)篇分析為翻譯研究和翻譯實(shí)踐提供了強(qiáng)大的理論支持,也為法律翻譯的研究領(lǐng)域開(kāi)拓了新的局面。筆者擬從語(yǔ)篇分析的視角出發(fā),對(duì)涉外訴訟文書(shū)的翻譯進(jìn)行全面系統(tǒng)的研究。首先,對(duì)涉外訴訟文書(shū)的基本概念加以闡述,介紹涉外訴訟文書(shū)翻譯的基本情況,對(duì)涉外訴訟文書(shū)翻譯中常見(jiàn)的問(wèn)題和原因進(jìn)行分析歸納,指出本文研究的現(xiàn)實(shí)意義。其二,從語(yǔ)篇的內(nèi)部因素出發(fā),對(duì)涉外訴訟文書(shū)翻譯過(guò)程中的遣詞構(gòu)句、語(yǔ)體特點(diǎn),篇章結(jié)構(gòu)進(jìn)行深入探討,以期在語(yǔ)言的表層結(jié)構(gòu)上提高涉外訴訟文書(shū)的翻譯質(zhì)量。其三,從語(yǔ)篇的外部因素出發(fā),對(duì)產(chǎn)生涉外訴訟文書(shū)特有的司法語(yǔ)境、法律體系和社會(huì)功能進(jìn)行研究,并指出在中國(guó)特有...
