【摘要】：警察權(quán)作為國(guó)家實(shí)現(xiàn)治理目的而實(shí)施的一項(xiàng)特殊權(quán)力,其配置和施行狀況體現(xiàn)了社會(huì)的法治化程度。當(dāng)前,警察權(quán)在運(yùn)行中還存在如立法條文模糊、執(zhí)法權(quán)力擴(kuò)張沖動(dòng)、執(zhí)法者素質(zhì)有待提高等問(wèn)題。本文以分析警察權(quán)特征為切入點(diǎn),從司法權(quán)和行政權(quán)角度探討警察權(quán)的權(quán)力屬性,通過(guò)有效規(guī)制警察權(quán)的運(yùn)行,從而實(shí)現(xiàn)構(gòu)建法治社會(huì)、保障人權(quán)的根本目的。
[Abstract]:Police power, as a special power implemented by the state to achieve the goal of governance, reflects the degree of the rule of law in the society. At present, there are still some problems in the operation of police power, such as the ambiguity of legislative provisions, the impulse of the expansion of law enforcement power and the need to improve the quality of law enforcers. Based on the analysis of the characteristics of police power, this paper discusses the power attributes of police power from the angle of judicial power and administrative power, and realizes the fundamental purpose of constructing a society ruled by law and safeguarding human rights by effectively regulating the operation of police power.
