【摘要】：從最初試點到全面推行的十多年間,我國政府采購制度經(jīng)歷了從無到有、從小到大的發(fā)展歷程,政府采購的規(guī)模日益龐大,采購程序也日益規(guī)范,發(fā)展速度不斷加快。但從現(xiàn)階段來看,中國政府采購制度的發(fā)展并不成熟,在具體的采購過程中還存在著許多問題。由于政府采購法制的不完備,機構權力過分集中,監(jiān)督機制的缺失,專家評委警惕心不強、法律意識淡薄,等等。政府采購中的職務犯罪尤為突出。政府采購中職務犯罪的特點表現(xiàn)為隱蔽性較強,商業(yè)性顯著,專家涉案人員較多,等等。此類犯罪的產(chǎn)生原因也是多種多樣,集中表現(xiàn)為采購法制不夠完善,分散采購弊端重重,本文結合我國采購制度,借鑒外國之先進經(jīng)驗,提出相應的預防策略,包括在立法方面,完善政府采購法規(guī)體系、完善預防腐敗方面的立法、完善刑法中職務犯罪的規(guī)定;在立法之外,實現(xiàn)政府采購與行賄檔案查詢系統(tǒng)的對接、建立健全政府采購監(jiān)督機制、充盈政府采購專家資源庫、加強政府采購隊伍自身建設等等。
[Abstract]:From the initial trial to the overall implementation of more than ten years, our government procurement system has experienced a process of development from scratch to existence, from small to large, the scale of government procurement is increasingly large, procurement procedures are also increasingly standardized, the speed of development continues to accelerate. However, at this stage, the development of Chinese government procurement system is not mature, there are still many problems in the specific procurement process. Due to the incomplete legal system of government procurement, excessive concentration of institutional power, lack of supervision mechanism, weak vigilance on the part of expert judges, weak legal consciousness, and so on. The official crime in government procurement is particularly prominent. The characteristics of duty crime in government procurement are strong concealment, remarkable commercial nature, more experts involved, and so on. The causes of this kind of crime are also various. The concentrated manifestation is that the procurement legal system is not perfect enough and the procurement system is scattered with many disadvantages. This paper combines the procurement system of our country, draws lessons from the advanced experience of foreign countries, and puts forward the corresponding prevention strategies. Including in the legislative aspect, consummates the government procurement legal system, consummates the prevention corruption aspect legislation, consummates the criminal law duty crime stipulation, in addition to the legislation, realizes the government procurement and the bribery file inquiry system docking, Establish and improve the supervision mechanism of government procurement, replenish the resource base of government procurement experts, and strengthen the construction of government procurement team itself.
