【摘要】：城管執(zhí)法工作隨著城市管理相關(guān)法規(guī)及執(zhí)法體制的完善而得到到了有效開展,這與城管自身方面的不斷提高有密切關(guān)系,同時也離不開被管理者的積極配合。近年來很多新聞和媒體都報道了城管執(zhí)法遭遇暴力抗法的現(xiàn)象,暴力抗法現(xiàn)象越來越嚴(yán)重,極大地?fù)p害了政府的形象,降低了法律威嚴(yán),同時也危害到被管理者的健康和財產(chǎn)安全,導(dǎo)致社會矛盾進(jìn)一步被激化。暴力抗法問題既復(fù)雜也棘手,只有將其很好地解決才能提高整體管理效果。論文以溫州市城市執(zhí)法中所遇到的暴力抗法現(xiàn)象作為研究對象,分析其產(chǎn)生的原因和解決對策,對提高城市管理效果具有重大意義。本文將綜合利用文獻(xiàn)資料法、案例分析法、調(diào)查問卷法和規(guī)范性研究方法,基于新公共服務(wù)理論和社會管理理論,對溫州市城管執(zhí)法中的暴力抗法問題展開研究。在對城市管理綜合執(zhí)法中暴力抗法等相關(guān)概念進(jìn)行界定的基礎(chǔ)上,對溫州市城市管理綜合執(zhí)法中暴力抗法的表現(xiàn)和危害進(jìn)行系統(tǒng)分析,并指出了溫州市城管綜合執(zhí)法管理存在的問題的原因。最后從被執(zhí)法者、執(zhí)法機(jī)構(gòu)、執(zhí)法環(huán)境三方面探索一條化解暴力抗法、切合實際、科學(xué)合理、和諧高效的溫州市城市管理綜合執(zhí)法對策,具體是:在被執(zhí)法者方面提出了扎實進(jìn)行暴力抗法危害性宣傳教育,加強(qiáng)對暴力抗法的懲治力度;執(zhí)法主體方面提出了端正城管執(zhí)法部門對暴力抗法的處理態(tài)度,提高城管執(zhí)法人員應(yīng)對暴力抗法的綜合能力,堅持文明執(zhí)法與強(qiáng)制執(zhí)法相結(jié)合;執(zhí)法環(huán)境方面提出了加強(qiáng)城管執(zhí)法中暴力抗法相關(guān)立法,逐步建立與公安系統(tǒng)執(zhí)法協(xié)作與保障機(jī)制。
[Abstract]:With the improvement of the relevant laws and regulations of urban management and the law enforcement system, the law enforcement work of urban management has been carried out effectively, which is closely related to the continuous improvement of urban management itself, and can not be separated from the active cooperation of the managed. In recent years, many news and media have reported that the law enforcement of urban management has encountered the phenomenon of violent resistance to the law. The phenomenon of violent resistance to the law has become more and more serious, which has greatly damaged the image of the government and reduced the dignity of the law. At the same time, it also endangers the health and property safety of the managed, resulting in further intensification of social contradictions. The problem of violent anti-law is both complex and thorny, only by solving it well can we improve the overall management effect. This paper takes the phenomenon of violence and resistance to law in Wenzhou city law enforcement as the research object, and analyzes its causes and countermeasures, which is of great significance to improve the effect of urban management. This paper will make comprehensive use of literature method, case analysis method, questionnaire method and normative research method, based on the new public service theory and social management theory, to study the problem of violent anti-law in Wenzhou city management law enforcement. On the basis of defining the related concepts of violence resistance law enforcement in urban management comprehensive law enforcement, this paper makes a systematic analysis on the performance and harm of violence resistance law enforcement in Wenzhou city management comprehensive law enforcement. The causes of the problems existing in the comprehensive law enforcement management of Wenzhou City Management are pointed out. Finally, from the three aspects of law enforcement, law enforcement agencies and law enforcement environment, this paper explores a comprehensive law enforcement strategy of Wenzhou city management, which is realistic, scientific and reasonable, harmonious and efficient. Specifically, in the aspect of the law enforcement, the author puts forward the propaganda and education of the harmfulness of violent resistance to the law, and strengthens the punishment of violent resistance to the law; In the aspect of law enforcement, the author puts forward to correct the attitude of urban management law enforcement departments towards violent resistance to the law, improve the comprehensive ability of urban management law enforcement personnel to deal with violent resistance to the law, and adhere to the combination of civilized law enforcement and compulsory law enforcement. In the aspect of law enforcement environment, this paper puts forward to strengthen the relevant legislation of violence and anti-law in urban management law enforcement, and gradually establish the cooperation and guarantee mechanism with the law enforcement of public security system.
