城市地下管線PPP模式調(diào)控法律問(wèn)題研究

【摘要】:近些年來(lái),全國(guó)許多地區(qū)相繼推廣城市地下管線建設(shè),而且大部分省市為了規(guī)制這一新型項(xiàng)目建設(shè)、運(yùn)營(yíng)等行為也出臺(tái)了城市地下管線條例。同時(shí),面對(duì)近年來(lái)經(jīng)濟(jì)下行和財(cái)政減收的雙重壓力,從中央到地方相繼出臺(tái)了一系列政策文件:鼓勵(lì)采用政府和社會(huì)資本合作(即PPP)模式推動(dòng)基礎(chǔ)設(shè)施和公共服務(wù)項(xiàng)目的順利開展。故而,面對(duì)這種新的經(jīng)濟(jì)合作模式,政府如何更好地對(duì)PPP模式進(jìn)行宏觀調(diào)控,如何制定有效的法律對(duì)該種行為提供制度保障,以促進(jìn)PPP模式下城市地下管線項(xiàng)目的健康發(fā)展,是我國(guó)目前亟需解決的現(xiàn)實(shí)問(wèn)題。因此,本文對(duì)城市地下管線PPP調(diào)控模式的理論及其法律問(wèn)題進(jìn)行探討分析,具有一定的理論和現(xiàn)實(shí)意義。本文采用文獻(xiàn)分析法、比較研究法和法經(jīng)濟(jì)學(xué)分析法等方法,從PPP模式的概念特征及其經(jīng)濟(jì)法理念、地下管線PPP調(diào)控的現(xiàn)有政策文件以及主體與客體、權(quán)利義務(wù)關(guān)系等角度進(jìn)行綜合分析,總結(jié)出我國(guó)城市地下管線PPP調(diào)控中存在的現(xiàn)實(shí)問(wèn)題,并借鑒境內(nèi)外的先進(jìn)經(jīng)驗(yàn),對(duì)完善我國(guó)城市地下管線PPP調(diào)控提出了相應(yīng)的對(duì)策。全文共分為三個(gè)部分:第一部分是對(duì)PPP模式與政府調(diào)控的理論分析。這一部分首先在對(duì)現(xiàn)有資料進(jìn)行歸類整理的基礎(chǔ)上,概括分析了PPP的概念和基本特征。其次分析了PPP模式下政府的地位以及政府運(yùn)用宏觀經(jīng)濟(jì)調(diào)控手段的理論依據(jù)。具體講,就是依據(jù)經(jīng)濟(jì)法“市場(chǎng)調(diào)節(jié)—市場(chǎng)失靈—政府干預(yù)—政府失靈—對(duì)政府干預(yù)的干預(yù)”的理論分析路徑,對(duì)PPP模式下開展城市地下管線等公共基礎(chǔ)設(shè)施建設(shè)的行為進(jìn)行分析。第二部分是對(duì)城市地下管線PPP模式相關(guān)政策法律分析。這一部分首先是政策分析,通過(guò)對(duì)國(guó)務(wù)院關(guān)于“城市地下管線”、“地下綜合管廊”等相關(guān)文件的對(duì)比分析,可以看出中央對(duì)大力發(fā)展城市地下管線工程的重視程度;通過(guò)對(duì)地方相關(guān)立法的對(duì)比分析,發(fā)現(xiàn)許多內(nèi)容都是對(duì)國(guó)務(wù)院文件的轉(zhuǎn)述,缺乏地域特色。這些地方立法能否在實(shí)踐中真正起到引導(dǎo)和規(guī)制作用,有待實(shí)踐檢驗(yàn)。其次,從法律關(guān)系三要素角度對(duì)城市地下管線PPP調(diào)控的主體、客體和內(nèi)容進(jìn)行分析,旨在明確各方主體的職權(quán)與責(zé)任,權(quán)利與義務(wù)。第三部分是城市地下管線PPP調(diào)控法律機(jī)制的完善。這一部分通過(guò)總結(jié)2014年至今PPP模式下的城市地下管線工程在具體操作中存在的問(wèn)題,結(jié)合境內(nèi)外代表性經(jīng)驗(yàn),得出應(yīng)該在遵守社會(huì)公共利益原則的基礎(chǔ)上做到立法先行的結(jié)論。具體從完善立法、加強(qiáng)監(jiān)督、提升各方主體的PPP專業(yè)知識(shí)和鼓勵(lì)運(yùn)用獎(jiǎng)懲機(jī)制等方面提出了一系列對(duì)策建議。
[Abstract]:In recent years, many areas of the country have promoted the construction of urban underground pipelines, and most provinces and cities have issued regulations on urban underground pipelines in order to regulate the construction of this new type of projects. At the same time, in the face of the dual pressure of economic downturn and fiscal revenue reduction in recent years, From the central government to the local government, a series of policy documents have been issued one after another: encouraging the use of government and social capital cooperation (PPP) model to promote the smooth development of infrastructure and public service projects. Therefore, in the face of this new economic cooperation model, how can the government better regulate and control the PPP model, and how to formulate effective laws to provide institutional protection for this kind of behavior, in order to promote the healthy development of urban underground pipeline projects under the PPP mode? It is a practical problem that needs to be solved urgently in our country at present. Therefore, this paper discusses and analyzes the theory and legal problems of PPP regulation mode of urban underground pipeline, which has certain theoretical and practical significance. This paper adopts the methods of literature analysis, comparative research and law and economics analysis, from the concept characteristics of PPP model and its economic law concept, the existing policy documents of underground pipeline PPP regulation and control, as well as the subject and object. Based on the comprehensive analysis of the relationship between rights and obligations, this paper summarizes the practical problems existing in the regulation and control of PPP in urban underground pipelines in China, and draws lessons from the advanced experience at home and abroad, and puts forward some corresponding countermeasures for perfecting the PPP regulation and control of urban underground pipelines in China. The full text is divided into three parts: the first part is the theoretical analysis of PPP model and government regulation. In this part, the concept and basic characteristics of PPP are summarized and analyzed on the basis of classifying and sorting out the existing data. Secondly, it analyzes the status of the government under the PPP model and the theoretical basis of the government's use of macroeconomic control means. Specifically, it is based on the theoretical analysis of the economic law "Market Regulation-Market failure-Government intervention-Government failure-intervention in Government intervention". This paper analyzes the behavior of carrying out the construction of public infrastructure such as urban underground pipeline under PPP mode. The second part is the analysis of the policies and laws related to the PPP model of urban underground pipelines. This part is first of all policy analysis. Through the comparative analysis of the relevant documents such as "Urban Underground Pipeline" and "Underground Integrated Pipeline Corridor" of the State Council, we can see that the central government attaches great importance to the development of urban underground pipeline engineering. Through the comparative analysis of local relevant legislation, it is found that many contents are restated to the documents of the State Council and lack of regional characteristics. Whether these local legislation can really play a guiding and regulatory role in practice needs to be tested in practice. Secondly, the subject, object and content of PPP regulation and control of urban underground pipeline are analyzed from the point of view of three elements of legal relationship, in order to clarify the functions, powers and responsibilities, rights and obligations of each subject. The third part is the improvement of the legal mechanism of PPP regulation and control of urban underground pipeline. In this part, by summing up the problems existing in the concrete operation of urban underground pipeline project under PPP mode from 2014 to now, and combining with the representative experience at home and abroad, this part draws the conclusion that legislation should be taken first on the basis of abiding by the principle of social and public interest. This paper puts forward a series of countermeasures and suggestions from the aspects of perfecting legislation, strengthening supervision, promoting the professional knowledge of PPP and encouraging the use of reward and punishment mechanism.
