從我國現(xiàn)行政策看男性陪產(chǎn)假入法的可行性

【摘要】:男性陪產(chǎn)假,即男性在妻子生育時(shí)享受的一定時(shí)間的看護(hù)妻子、照料新生兒和家庭的假期,因?yàn)榕惝a(chǎn)假是基于女性生育的事實(shí),依附于女性的產(chǎn)假,因此男性享受的這段假期稱之為"陪產(chǎn)假"。目前我國尚未有全國性的法律法規(guī)對陪產(chǎn)假作出相關(guān)規(guī)定,僅各省在《人口與計(jì)劃生育條例》中自主地規(guī)定了男性的陪產(chǎn)假或護(hù)理假及假期期間的薪資。但隨著"二孩"政策的全面開放、對《人口與計(jì)劃生育法》的修改以及我國對男女平等的堅(jiān)持與貫徹,筆者認(rèn)為將男性陪產(chǎn)假寫入法律是現(xiàn)實(shí)的,可行的。
[Abstract]:Male paternity leave, that is, the period of time a man takes care of his wife during the birth of his wife, and takes care of the newborn and family leave, because paternity leave is based on the fact that a woman gives birth and depends on the maternity leave of a woman, Therefore, the leave that men enjoy is called paternity leave. At present, there are no national laws and regulations on paternity leave in our country. Only the provinces independently stipulate the paternity leave or nursing leave and the salary during the leave in the population and Family Planning regulations. However, with the comprehensive opening of the "two-child" policy, the revision of the population and Family Planning Law and the persistence and implementation of equality between men and women in our country, the author believes that it is realistic and feasible to write male paternity leave into the law.
