社會(huì)撫養(yǎng)費(fèi)制度的完善

【摘要】：中國作為發(fā)展中國家，人口問題是制約我國社會(huì)經(jīng)濟(jì)發(fā)展的一重要問題，為了有效的解決人口問題，我國制定和實(shí)施了計(jì)劃生育的基本國策。在該政策的實(shí)施下，我國人口增長率控制成效明顯，人口素質(zhì)也得到了提高，但由于受各種因素的影響，我國人口問題的解決依然任重而道遠(yuǎn)。 與此同時(shí)，隨著改革開放的不斷深化，我國在法治建設(shè)之路上取得了巨大成效，法律制度不斷健全，行政執(zhí)法水平日益提高。在此大背景下，我國正式出臺(tái)和實(shí)施了社會(huì)撫養(yǎng)費(fèi)制度，以法律的形式對其作了明確的規(guī)定，至此，社會(huì)撫養(yǎng)費(fèi)制度從以前的生育行政管理制度變成了一項(xiàng)法律制度。此制度在隨后的實(shí)施中取得了巨大的成果，，但是在成果背后，也存在著不少問題，因此，對此項(xiàng)制度的研究具有重大的意義。 圍繞社會(huì)撫養(yǎng)費(fèi)制度，本文共分為四章：。 第一章，社會(huì)撫養(yǎng)費(fèi)的概述。在本章，闡述了社會(huì)撫養(yǎng)費(fèi)的內(nèi)涵、、法律特征、性質(zhì)。以期對社會(huì)撫養(yǎng)費(fèi)有一個(gè)全面的認(rèn)識(shí)。 第二章，社會(huì)撫養(yǎng)費(fèi)的合理性論證。本章通過理論基礎(chǔ)、我國國情、法治進(jìn)步三個(gè)角度對社會(huì)撫養(yǎng)費(fèi)的合理性進(jìn)行探討。 第三章，社會(huì)撫養(yǎng)費(fèi)制度的運(yùn)行現(xiàn)狀及問題原因分析。本章闡述了社會(huì)撫養(yǎng)費(fèi)運(yùn)行中四個(gè)突出的問題，這四個(gè)問題不僅關(guān)系著社會(huì)撫養(yǎng)費(fèi)的順利運(yùn)行，還關(guān)系著我國人口政策的長遠(yuǎn)實(shí)施。 第四章，社會(huì)撫養(yǎng)費(fèi)的完善。在現(xiàn)階段社會(huì)撫養(yǎng)費(fèi)的存在有其合理性，我們有必要為其的完善提出系統(tǒng)而合理的對策。
[Abstract]:As a developing country, population problem is an important problem that restricts the social and economic development of our country. In order to solve the population problem effectively, China has formulated and implemented the basic national policy of family planning. Under the implementation of this policy, the control effect of population growth rate in our country is obvious, and the population quality has also been improved. However, due to the influence of various factors, the solution of population problem in our country still has a long way to go. At the same time, with the deepening of reform and opening up, great achievements have been made in the construction of the rule of law in our country, the legal system is constantly improving, and the level of administrative law enforcement is improving day by day. Under this background, our country formally introduced and implemented the social maintenance system, made the explicit stipulation to it in the form of the law, thus, the social maintenance system changed from the previous birth administration system to a legal system. This system has made great achievements in the subsequent implementation, but there are still many problems behind the results. Therefore, the study of this system is of great significance. Around the social maintenance system, this article is divided into four chapters:. The first chapter is an overview of social alimony. In this chapter, the connotation, legal characteristics and nature of social alimony are expounded. In order to have a comprehensive understanding of social maintenance. The second chapter, the reasonable argument of social alimony. In this chapter, the rationality of social alimony is discussed from the theoretical basis, the situation of our country and the progress of the rule of law. The third chapter, the operation of the social maintenance system and the causes of the problems. This chapter expounds four outstanding problems in the operation of social alimony, which are not only related to the smooth operation of social maintenance, but also related to the long-term implementation of population policy in China. Chapter four, the perfection of social alimony. At the present stage, the existence of social alimony has its rationality, it is necessary for us to put forward systematic and reasonable countermeasures for its perfection.
