【摘要】：行為人多次實(shí)施同種違法行為從而被刑法規(guī)定為犯罪的情形謂之多次犯,多次犯入罪的理論依據(jù)在于多次反復(fù)違法導(dǎo)致行為整體的社會(huì)危害性達(dá)到了刑罰介入的界點(diǎn),是行為體現(xiàn)出的客觀危害和主觀危險(xiǎn)兩方面共同積累的結(jié)果,其中主觀危險(xiǎn)性因素處于主導(dǎo)地位�；�于刑罰與行政處罰的性質(zhì)關(guān)聯(lián),二者在交叉適用時(shí)應(yīng)當(dāng)堅(jiān)持禁止重復(fù)評(píng)價(jià)原則,但是,該原則發(fā)揮作用的場(chǎng)域并不及于主觀人身危險(xiǎn)性的認(rèn)定,因此,將多次犯中受過(guò)行政處罰的行為次數(shù)累計(jì)在"多次"之中并不違背該原則,但對(duì)于體現(xiàn)客觀危害要素的犯罪數(shù)額,如果已經(jīng)受到行政處罰的應(yīng)當(dāng)在犯罪數(shù)額認(rèn)定時(shí)予以扣除。
[Abstract]:When the perpetrator commits the same kind of illegal act many times and is defined as a crime by the criminal law, the theoretical basis of the repeated crime is that the social harmfulness of the behavior as a whole has reached the point of penalty intervention. It is the result of the accumulation of both objective harm and subjective danger, in which subjective risk factors are dominant. Based on the nature of penalty and administrative punishment, They should insist on the principle of prohibiting repeated evaluation when they are cross-applied. However, the field where the principle plays a role is not equal to the identification of subjective personal danger. It is not contrary to this principle to accumulate the number of times of administrative punishment in many crimes, but the amount of crime which reflects the elements of objective harm should be deducted when the amount of crime has been determined by administrative punishment.
