【摘要】：認(rèn)定檔案違法行為涉刑事犯罪,要弄清楚違法行為與犯罪行為的區(qū)別以及涉刑事犯罪的內(nèi)涵,以《刑法》規(guī)定的數(shù)額、危害程度和"兩高"、公安部的相關(guān)立案標(biāo)準(zhǔn)等為依據(jù);涉刑事檔案行政案件的移送要遵循合法的程序與要求,做到移送去向正確、移送程序合法、移送材料齊全。
[Abstract]:To find out the difference between illegal acts and criminal acts and the connotation of criminal crimes, it is necessary to find out the difference between illegal acts and criminal acts and the connotation of criminal crimes, based on the amount stipulated in the Criminal Law, the degree of harm and the relevant standards of filing by the Ministry of Public Security. The transfer of administrative cases involving criminal files should follow the legitimate procedures and requirements, so that the transfer procedure is correct, the transfer procedure is legal, and the transfer materials are complete.
