【摘要】：隨著網(wǎng)絡技術(shù)的不斷發(fā)展,網(wǎng)絡兒童色情制品犯罪形勢日益嚴峻,該罪不僅破壞了一國的社會秩序和公共道德,同時也給作為攝制對象的兒童造成了巨大的身體和心靈的傷害。國際組織和世界各國紛紛完善刑法規(guī)制體系,利用行政管制和技術(shù)手段,以遏制網(wǎng)絡兒童色情信息的傳播、打擊網(wǎng)絡兒童色情制品犯罪的上升勢頭。本文從介紹網(wǎng)絡兒童色情制品犯罪的全球形勢出發(fā),旨在分析網(wǎng)絡兒童色情制品犯罪的嚴峻形勢和危害,從而引出研究此問題的必要性。隨后又從該罪侵犯的客體、網(wǎng)絡兒童色情制品概念厘定、網(wǎng)絡兒童色情制品犯罪范圍界定以及網(wǎng)絡管制的技術(shù)手段和各國的管制模式四個角度,全面論證全球各國對于此罪的規(guī)制現(xiàn)狀和打擊途徑。最后一部分幾種分析我國目前的立法現(xiàn)狀和缺陷,以期通過借鑒國外理論和實務經(jīng)驗,尋找適合我國國情的刑法規(guī)制模式,彌補我國對于網(wǎng)絡兒童色情犯罪的刑法規(guī)制的漏洞和不足。同時通過學習外國打擊網(wǎng)絡兒童色情犯罪的技術(shù)手段和先進經(jīng)驗,建立適于我國國情的網(wǎng)絡管制模式,加強與網(wǎng)絡行業(yè)主體的溝通及合作,逐步建立和完善網(wǎng)絡行業(yè)的自律制度。兒童是一個國家的未來,網(wǎng)絡兒童色情內(nèi)容的泛濫正深深傷害著一國的未來。本文希望通過對網(wǎng)絡兒童色情制品犯罪的研究,為我國刑事司法建設和網(wǎng)絡色情管制提供可以參考的模型和建議,從而為我國兒童創(chuàng)造安全的上網(wǎng)環(huán)境,全面保護兒童的身心健康,有效打擊網(wǎng)絡兒童色情制品犯罪。
[Abstract]:With the continuous development of network technology, the crime of child pornography on the Internet is becoming more and more serious. The crime not only destroys the social order and public morality of a country, but also causes great bodily and mental harm to the children who are the object of filming. International organizations and countries all over the world have improved the criminal law regulation system and used administrative control and technical means to curb the spread of online child pornography information and to combat the rising trend of network child pornography crimes. Based on the introduction of the global situation of the child pornography crime on the Internet, this paper aims to analyze the severe situation and harm of the child pornography crime on the network, which leads to the necessity of studying this problem. Then, from four angles: the object of the crime, the definition of the concept of network child pornography, the definition of the scope of the crime of network child pornography, the technical means of the network control and the control mode of various countries, Comprehensive demonstration of the global regulation of this crime and the current situation of the way to combat. In the last part, the author analyzes the current situation and defects of our country's legislation in order to find the model of criminal law regulation suitable for our country's national conditions by learning from foreign theories and practical experiences. Make up for the loophole and insufficiency of criminal law regulation of network child pornography in our country. At the same time, by studying the technical means and advanced experience of foreign countries in combating child pornography on the Internet, we should establish a network control model suitable for the national conditions of our country, and strengthen communication and cooperation with the main bodies of the network industry. Gradually establish and improve the network industry self-discipline system. Children are the future of a country, the proliferation of online child pornography is deeply hurting the future of a country. This paper hopes to provide a model and suggestions for the construction of criminal justice and the regulation of network pornography through the study of the crime of child pornography on the Internet, so as to create a safe online environment for the children of our country. Fully protect the physical and mental health of children, effectively crack down on child pornography online crime.
