【摘要】：網(wǎng)絡(luò)釣魚是指行為人模仿某些知名網(wǎng)站、發(fā)送大量的垃圾郵件來誘騙被害人透露自己的身份信息或者通過木馬病毒記錄瀏覽者的身份信息的行為。網(wǎng)絡(luò)釣魚的常見行為方式有：仿冒知名網(wǎng)站,大量發(fā)送垃圾郵件,在正規(guī)網(wǎng)站植入木馬病毒。網(wǎng)絡(luò)釣魚的泛濫有三方面的原因：一是客觀方面立法不夠完善,二是犯罪主體方面網(wǎng)絡(luò)釣魚的“低投入高回報”性,三是被害人的認(rèn)識和心理方面的原因。網(wǎng)絡(luò)釣魚納入刑法規(guī)制非常必要而且可行。網(wǎng)絡(luò)釣魚的刑法立法要遵循下列原則：一是必須遵循刑法的基本原則和尊重基本人權(quán)的原則,二是平衡協(xié)調(diào)原則,三是國際合作原則。通過刑法修正案設(shè)立一個新的罪名將網(wǎng)絡(luò)釣魚行為入罪是目前最為合適的立法模式。關(guān)于增設(shè)何種罪名,各種觀點各有利弊。設(shè)立盜竊身份信息罪可以對網(wǎng)絡(luò)釣魚進(jìn)行有效的規(guī)制。
[Abstract]:Phishing refers to the behavior that the perpetrator imitates some well-known websites and sends a lot of spam to trick the victim into revealing his identity information or record the visitor's identity information through Trojan horse virus. Phishing common behavior: counterfeit well-known websites, a large number of spam, in the regular site implanted Trojan horse virus. There are three reasons for the flooding of phishing: the imperfection of objective legislation, the "low investment and high return" of phishing in the subject of crime, and the cognitive and psychological reasons of the victim. Phishing into the criminal law regulation is very necessary and feasible. The legislation of phishing criminal law should follow the following principles: first, the basic principles of criminal law and respect for basic human rights, the second is the principle of balance and coordination, and the third is the principle of international cooperation. It is the most appropriate legislative model to establish a new offence of phishing through the amendment of criminal law. There are pros and cons of what the new charges are. Setting up the crime of stealing identity information can effectively regulate phishing.
