拒不支付勞動(dòng)報(bào)酬罪的行為構(gòu)成研究

【摘要】:勞動(dòng)是人類最普遍的社會(huì)活動(dòng),勞動(dòng)報(bào)酬的獲取關(guān)系著勞動(dòng)者的生存和發(fā)展。隨著市場經(jīng)濟(jì)的發(fā)展,新的道德體系面臨重構(gòu)之前,依靠此前的道德體系支撐的經(jīng)濟(jì)關(guān)系失去了規(guī)范,勞資關(guān)系作為市場經(jīng)濟(jì)關(guān)系中重要的一環(huán),屢陷困境。惡性欠薪事件頻發(fā)引發(fā)了全社會(huì)對(duì)欠薪問題的關(guān)注,雇主拒不付薪行為,不但會(huì)使勞動(dòng)者生活陷入困境,同時(shí)也阻礙了我國經(jīng)濟(jì)秩序的穩(wěn)定與和諧發(fā)展。為了遏制惡意欠薪行為,2011年施行的《刑法修正案(八)》正式在我國刑法領(lǐng)域規(guī)制嚴(yán)重的拒付薪酬行為。該法實(shí)施以來,雖在理論指導(dǎo)實(shí)踐上給予了處于弱勢地位的勞動(dòng)者一定的保護(hù),但是,本罪實(shí)施6年以來,在司法實(shí)務(wù)處理中,對(duì)拒付薪酬的行為是否入罪的判定仍存有不同的觀點(diǎn)。因此,有必要對(duì)實(shí)施本罪的行為構(gòu)成作進(jìn)一步的分析和探討,以便運(yùn)用好本罪,讓本罪能發(fā)揮出它最大的效應(yīng)。拒不支付勞動(dòng)報(bào)酬罪的行為主體違反刑法的命令規(guī)范,不為刑法所要求或期待的行為,是典型的純正不作為犯。根據(jù)不作為犯罪的構(gòu)成要素,對(duì)本罪的行為構(gòu)成研究主要從犯罪主體有支付勞動(dòng)報(bào)酬的義務(wù)、具有支付勞動(dòng)報(bào)酬的能力而不履行支付勞動(dòng)報(bào)酬的義務(wù)的角度進(jìn)行構(gòu)思:首先,闡述本罪行為的含義及構(gòu)成要素;其次,明確支付勞動(dòng)報(bào)酬的義務(wù)來源及勞動(dòng)報(bào)酬的范圍;再次,從有利于實(shí)操的角度對(duì)行為主體有支付勞動(dòng)報(bào)酬的能力進(jìn)行實(shí)質(zhì)判斷及具有支付能力的時(shí)間進(jìn)行界定;最后,對(duì)具有履行支付勞動(dòng)報(bào)酬的義務(wù)而不履行的行為從時(shí)間和程序上進(jìn)行分析與界定。通過對(duì)該罪行為構(gòu)成的分析,提高在實(shí)踐中對(duì)該罪行為的認(rèn)識(shí),以期達(dá)到在眾多不支付勞動(dòng)報(bào)酬的行為中準(zhǔn)確判斷哪些屬于刑法所規(guī)制的目的。
[Abstract]:Labor is the most common social activity of human being. The obtaining of labor reward is related to the survival and development of laborer. With the development of market economy, the economic relationship supported by the previous moral system has lost its standard before the new moral system is faced with reconstruction. As an important part of the market economy relationship, labor relations have repeatedly fallen into difficulties. The frequent occurrence of vicious incidents of unpaid wages has caused the whole society to pay attention to the problem of unpaid wages. The refusal of employers to pay wages will not only lead workers into difficulties in their lives, but also hinder the stability and harmonious development of economic order in our country. In order to curb the maliciously unpaid wages, the Criminal Law Amendment (8), which was carried out in 2011, formally regulated the serious refusal to pay in the criminal law field of our country. Since the implementation of the law, although it has given certain protection to workers in a weak position in theory and practice, it has been dealt with in judicial practice since the implementation of this crime six years ago. There are still different views on whether the refusal to pay is an offence. Therefore, it is necessary to make further analysis and discussion on the composition of the behavior of the crime, so as to make good use of the crime and make this crime exert its maximum effect. It is a typical pure omission that the subject of the crime of refusing to pay labor remuneration violates the order norm of the criminal law and is not required or expected by the criminal law. According to the constituent elements of the crime of omission, the research on the behavior constitution of this crime is mainly from the angle that the subject of the crime has the obligation to pay the remuneration for labor, and has the ability to pay the remuneration of labor, but not to fulfill the obligation of paying the remuneration of the work: first of all, Explain the meaning of the crime and its constituent elements; secondly, clear the source of the obligation to pay the remuneration for labor and the scope of the remuneration; again, From the point of view of actual operation, the author makes a substantial judgment on the ability of the behavior subject to pay the labor reward and defines the time of the ability to pay; finally, This paper analyzes and defines the time and procedure of failure to fulfill the obligation to pay for labor. Through the analysis of the constitution of the crime, the author raises the understanding of the crime in practice, in order to accurately judge which is regulated by the criminal law among the many behaviors which do not pay the labor reward.
