【摘要】：聚眾斗毆罪作為聚眾犯罪的一種，在我國的刑事司法實踐中極為常見，但我國現(xiàn)行刑法對其沒有明確、完善的認定標準，學界對其相關(guān)理論也缺乏共識，導致實際司法處理該罪時參照標準與最終裁判結(jié)果差異較大。本文在厘清“聚眾斗毆罪”概念的基礎上，著重分析了聚眾斗毆犯罪情節(jié)的四個法定要素，，分別從犯罪次數(shù)、主體人數(shù)、規(guī)模以及犯罪方式等四個方面逐一進行論述，為聚眾斗毆犯罪確立入罪標準，并詳細闡釋了聚眾斗毆的加重情節(jié)以及內(nèi)在邏輯。針對聚眾斗毆罪的轉(zhuǎn)化問題，本文從基本罪的犯罪行為、犯罪狀態(tài)以及不同的犯罪主體分析聚眾斗毆犯罪轉(zhuǎn)化的條件，為聚眾斗毆犯罪轉(zhuǎn)化確立認定方法。最后本文對聚眾斗毆罪中存在的其他疑難問題進行論述，解決了司法實務中該罪存在的問題。
[Abstract]:As a kind of mass crime, the crime of affray is very common in the criminal judicial practice of our country. However, the current criminal law of our country does not have clear and perfect standards for its cognizance, and there is also a lack of consensus in academic circles on its related theories. As a result, there is a great difference between the standard of reference and the result of final judgment in the actual judicial treatment of the crime. On the basis of clarifying the concept of "affray crime", this paper emphatically analyzes the four legal elements of the crime of affray crime, which are discussed one by one from four aspects: the number of crimes, the number of subjects, the scale and the way of crime. This paper establishes the standard of incrimination for the affray crime, and explains in detail the aggravating circumstances and internal logic of the affray. In view of the transformation of the crime of affray, this paper analyzes the conditions of the transformation of the crime of affray from the basic crime, the state of the crime and the different subject of the crime, and establishes the identification method for the transformation of the crime of affray. Finally, this paper discusses the other difficult problems in the crime of affray, and solves the problems in the judicial practice.
