【摘要】: 作為一種新型用工方式,勞務(wù)派遣改變了傳統(tǒng)勞動(dòng)關(guān)系中用人單位與勞動(dòng)者之間的法律地位,使被派遣勞動(dòng)者受到派遣單位與用工單位的雙重約束,但其作為勞動(dòng)者的基本權(quán)利卻在這種復(fù)雜的關(guān)系中得不到應(yīng)有的保護(hù)。勞務(wù)派遣立法的相對(duì)滯后和缺失、制度的不完善,是被派遣勞動(dòng)者勞動(dòng)權(quán)得不到保障的主要原因。因此,本文從分析勞務(wù)派遣法律關(guān)系的性質(zhì)入手,并在借鑒世界各國關(guān)于被派遣勞動(dòng)者勞動(dòng)權(quán)保護(hù)的相關(guān)法律制度基礎(chǔ)上,總結(jié)了目前我國勞務(wù)派遣中存在的妨害被派遣勞動(dòng)者勞動(dòng)權(quán)實(shí)現(xiàn)的主要問題及對(duì)現(xiàn)行立法的相關(guān)規(guī)定進(jìn)行了檢討,提出了對(duì)我國勞務(wù)派遣立法規(guī)制的總體構(gòu)想和具體制度設(shè)計(jì),以期被派遣勞動(dòng)者的勞動(dòng)權(quán)得到有效的保護(hù),促進(jìn)勞務(wù)派遣的良性發(fā)展以及勞動(dòng)關(guān)系的和諧。
[Abstract]:As a new mode of employment, labor dispatch has changed the legal status between employers and workers in the traditional labor relations, so that dispatched workers are subject to the dual constraints of dispatch units and employment units. But its basic rights as a laborer can not be protected properly in this complicated relationship, the relative lag and lack of labor dispatch legislation, the imperfect system. It is the main reason that the labor rights of dispatched workers can not be guaranteed. Therefore, this paper starts with the analysis of the nature of the legal relationship of labor dispatch. And on the basis of drawing lessons from the countries in the world on the protection of the labor rights of dispatched workers on the basis of the relevant legal system. This paper summarizes the main problems that hinder the realization of the labor rights of dispatched workers in China and reviews the relevant provisions of the current legislation. This paper puts forward the general conception and concrete system design of legislation regulation of labor dispatch in our country in order to protect the labor rights of dispatched workers effectively and promote the benign development of labor dispatch and the harmony of labor relations.
