【摘要】：隨著國(guó)際社會(huì)的發(fā)展,國(guó)籍法衍生了消除國(guó)籍沖突引發(fā)的問題、國(guó)籍不等同公民權(quán)、取得多國(guó)國(guó)籍三項(xiàng)新原則。與此同時(shí),很多國(guó)家紛紛修改完善國(guó)籍法,核心是承認(rèn)雙重國(guó)籍,松動(dòng)擁有國(guó)籍等同公民權(quán)原則,以追求和實(shí)現(xiàn)本國(guó)利益的最大化。中國(guó)《國(guó)籍法》實(shí)施30年來幾乎沒有任何變化,存在著許多與國(guó)際形勢(shì)、國(guó)家利益不相協(xié)調(diào)的地方。修訂《國(guó)籍法》時(shí),有必要認(rèn)真考慮和平衡集中居住在東南亞地區(qū)的多數(shù)華僑華人和分散居住在歐美澳的新華僑華人的利益。改革的可行方案是漸進(jìn)有序地推進(jìn)務(wù)實(shí)靈活的雙重國(guó)籍政策,從寬對(duì)待華人恢復(fù)國(guó)籍和入籍問題,同時(shí),預(yù)設(shè)制度以防范認(rèn)可雙重國(guó)籍可能引發(fā)的沖突。
[Abstract]:With the development of the international community, nationality law has derived from the elimination of nationality conflicts, nationality is not equal to citizenship, the acquisition of multi-national nationality three new principles. At the same time, many countries have amended and perfected their nationality laws, the core of which is to recognize dual nationality and loosen the principle of citizenship and equal citizenship, in order to pursue and realize the maximization of their own interests. China's nationality Law has hardly changed since its implementation 30 years ago, and there are many places which are not in harmony with the international situation and national interests. When revising the nationality Law, it is necessary to seriously consider and balance the interests of the majority of overseas Chinese living in Southeast Asia and the new overseas Chinese living in Europe, America and Macao. The feasible plan of the reform is to advance the pragmatic and flexible policy of dual nationality gradually and orderly, to treat the issue of Chinese nationality restoration and naturalization more leniently, and at the same time, to presuppose the system to prevent the conflict caused by the recognition of dual nationality.
