【摘要】：調(diào)解是隨著社會的發(fā)展而產(chǎn)生的一種糾紛解決方式,并且隨著社會的發(fā)展而不斷發(fā)展。我國的調(diào)解制度在經(jīng)歷興盛、衰退的階段之后,現(xiàn)在正處于復(fù)興時期。此時的復(fù)興并不是單純的復(fù)興,而是對我國以前的調(diào)解制度去其糟粕、取其精華的一個復(fù)興過程。立案調(diào)解制度就是在這個復(fù)興過程中產(chǎn)生的一個重要的制度。 現(xiàn)階段,各地法院紛紛實行立案調(diào)解制度,以作為對法院調(diào)解制度的改革和完善,取得了很大的成效。但是在實踐中由于沒有統(tǒng)一的法律規(guī)定,立案調(diào)解制度在理解和運用過程中產(chǎn)生一些混亂�；谝陨锨闆r,本文清楚地界定了立案調(diào)解制度的概念,在此基礎(chǔ)上論證了我國設(shè)立立案調(diào)解制度的必要性以及可行性,肯定了立案調(diào)解制度是我國司法實踐中的一大創(chuàng)新。最后,本文聯(lián)系我國的實際情況,借鑒國外的一些成功的調(diào)解經(jīng)驗,對我國的立案調(diào)解制度的設(shè)立提出一些建議,以期望立案調(diào)解制度在我國實踐中成功地發(fā)展。 本文共分為五個部分:第一部分在對立案調(diào)解的概念進行清晰界定的基礎(chǔ)上,對立案調(diào)解的內(nèi)涵進行了剖析。分析了立案調(diào)解制度產(chǎn)生是法院調(diào)解的復(fù)興、彌補現(xiàn)行法院調(diào)解機制運作中的缺陷和理論界的推動這三種原因共同作用的結(jié)果。同時介紹了我國法院現(xiàn)行的兩種立案調(diào)解的模式,對兩種模式進行比較,分析其優(yōu)缺點,突顯出我國建立立案調(diào)解制度需要法院調(diào)解、法院委托調(diào)解、邀請調(diào)解共同合作。 第二部分是對立案調(diào)解制度在我國實踐中的運行狀態(tài)的考察,肯定了我國立案調(diào)解制度運行中的成績(緩解審判壓力、符合和諧社會的要求),指出由于我國沒有關(guān)于立案調(diào)解制度的統(tǒng)一規(guī)定,各地法院各行其是,導(dǎo)致立案調(diào)解在實踐運行中產(chǎn)生很多的不足。 第三部分結(jié)合我國的實踐情況論證了立法上設(shè)立立案調(diào)解制度的基礎(chǔ);不論是從理論層面還是實踐經(jīng)驗來講,立案調(diào)解制度在我國都已經(jīng)有了孕育其的土壤,再加上司法實踐中對其的需要,所以設(shè)立立案調(diào)解制度勢在必行。 第四部分是對各國在立案階段的調(diào)解的做法做一個介紹,并對各國與我國的調(diào)解制度的不同之處做出分析,以鑒別出哪些經(jīng)驗值得我國借鑒,而哪些做法不適合我國的實際。 第五部分是在對我國的現(xiàn)狀進行分析之后,借鑒國外的一些成功經(jīng)驗,對我國設(shè)立立案調(diào)解制度提出一些建議。這一部分是本文的落腳點,重在堅持保障當事人的程序基本權(quán)和選擇權(quán)的基礎(chǔ)上,設(shè)立立案調(diào)解制度,以重新體現(xiàn)當事人合意這個調(diào)解的本質(zhì)。
[Abstract]:Mediation is a kind of dispute resolution method produced with the development of the society, and it develops continuously with the development of the society. After our country's mediation system has experienced the stage of prosperity and decline, We are now in a period of renaissance. The renaissance at this time is not a simple renaissance, but a dregs of the former mediation system of our country. The system of filing mediation is an important system in the process of revival. At the present stage, local courts have adopted the system of filing mediation one after another in order to reform and perfect the mediation system of the court, which has achieved great results. However, in practice, there is no unified legal regulation. Based on the above situation, this paper clearly defines the concept of filing mediation system, and on this basis demonstrates the necessity and feasibility of setting up a record mediation system in China. This paper affirms that the system of filing mediation is a great innovation in the judicial practice of our country. Finally, this article combines the actual situation of our country, draws lessons from some successful mediation experiences of foreign countries, and puts forward some suggestions on the establishment of the mediation system of our country. It is expected that the system of filing mediation will develop successfully in our country's practice. This paper is divided into five parts: the first part, on the basis of clearly defining the concept of the mediation on file, analyzes the connotation of the mediation on file, and analyzes that the emergence of the mediation system on file is the revival of the mediation of the court. This paper makes up for the defects in the operation of the current mediation mechanism of the court and the results of the joint action of the three reasons. At the same time, it introduces the two kinds of mediation modes of the court in our country, compares the two models, and analyzes their advantages and disadvantages. It is obvious that court mediation is needed to establish the mediation system in our country, and the court entrusts mediation and invites mediation to cooperate with each other. The second part is the investigation of the running state of the mediation system in our country, which affirms the achievements in the operation of the mediation system. In line with the requirements of a harmonious society, it is pointed out that due to the absence of a unified regulation on the system of filing mediation in our country, the courts in various places go their own way, which leads to a lot of deficiencies in the practice of filing mediation. The third part demonstrates the foundation of establishing the mediation system in the legislation according to the practice of our country. Whether from the theory level or the practical experience, the mediation system of the case filing has already had the soil to breed in our country. In addition, the needs of judicial practice, so it is imperative to establish a mediation system. The 4th part is an introduction to the mediation practices of countries in the filing stage, and an analysis of the differences between the mediation systems of various countries and China, in order to identify which experiences are worthy of our country's reference, and which practices are not suitable for the reality of our country. The 5th part is to analyze the present situation of our country, draw lessons from some successful experiences of foreign countries, and put forward some suggestions to establish the system of filing mediation in our country. This part is the foothold of this article. On the basis of protecting the basic right of procedure and the right of choice of the parties, the system of filing mediation should be set up so as to reflect the essence of the mediation agreed by the parties.
