【摘要】：調(diào)解制度已成為世界范圍內(nèi)廣為運用的重要的糾紛解決方式。中國的調(diào)解制度作為一種悠久的法律傳統(tǒng)在世界范圍內(nèi)受到廣泛的關注。人民調(diào)解是社會調(diào)解的最主要形式，作為和平解決民事糾紛的重要途徑，人民調(diào)解正在復興。我國正處在一個社會轉(zhuǎn)型期,在這一過程中,社會的各種矛盾和問題,往往首先表現(xiàn)為復雜而頻發(fā)的糾紛。只有正確處理人民內(nèi)部矛盾和其他社會矛盾，妥善協(xié)調(diào)各方面利益關系，才能最大限度激發(fā)社會創(chuàng)造力、最大限度減少不和諧因素，保持社會和諧穩(wěn)定。面對這種形勢,近年來,包括法院、司法行政機關、地方政府在內(nèi)的各有關機構組織,正在致力于通過分工與協(xié)調(diào)建構一個多元化的糾紛解決機制,以實現(xiàn)社會治安綜合治理,促進和保障社會的穩(wěn)定和健康發(fā)展,建立良好的法治秩序。人民調(diào)解制度作為其中極為關鍵的環(huán)節(jié),在社會轉(zhuǎn)型期同樣遇到許多新問題和挑戰(zhàn),如何對其進行改革完善,更好地發(fā)揮其特有的功能。2009年以來,廣州市蘿崗區(qū)聯(lián)和街為此進行了一系列積極的有益嘗試和探索。 蘿崗區(qū)聯(lián)和街已經(jīng)建立人民調(diào)解、行政調(diào)解、司法調(diào)解相互銜接的聯(lián)動機制，為及時化解社會糾紛提供了一個較好的平臺。構建了較為完善的工作機構和工作制度，，基本實現(xiàn)了三調(diào)互動和對接，取得了一定的社會效益。但聯(lián)和街的的人民調(diào)解聯(lián)動機制的發(fā)展遭遇到一定的困境，在運作過程中存在一些難以克服的弊端。政府主導部門行政管理觀念依然存在，調(diào)解范圍和糾紛類型雜糅在一起，落后的法治觀念依然根深蒂固地影響著聯(lián)動機制作用的發(fā)揮。借鑒國內(nèi)外調(diào)解實踐及經(jīng)驗，針對蘿崗區(qū)聯(lián)和街存在的問題，提出完善建議。 本文從維護社會和諧穩(wěn)定發(fā)展的基點出發(fā)，結合廣州市蘿崗區(qū)聯(lián)和街人民調(diào)解工作實踐，從理論研究、實證分析、立法規(guī)范和實務操作等方面對人民調(diào)解聯(lián)動機制進行深度研究。筆者從與人民調(diào)解及相關基礎理論出發(fā)，研究了國內(nèi)外調(diào)解制度的發(fā)展狀況及研究現(xiàn)狀、蘿崗區(qū)聯(lián)和街人民調(diào)解聯(lián)動機制的構建及其運作狀況，進而提出了完善聯(lián)和街人民調(diào)解聯(lián)動機制的若干建議，以期為蘿崗區(qū)聯(lián)和街人民調(diào)解聯(lián)動機制的建設和運用提供理論支撐。
[Abstract]:The mediation system has become an important method of dispute resolution widely used in the world. As a long legal tradition, China's mediation system has been widely concerned in the world. People's mediation is the most important form of social mediation. As an important way to resolve civil disputes peacefully, people's mediation is reviving. Our country is in a period of social transformation. In this process, social contradictions and problems, Only by correctly handling contradictions among the people and other social contradictions, and by properly coordinating the interests of all parties, can the creativity of society be maximized and the factors of disharmony be minimized. Maintain social harmony and stability. In the face of this situation, in recent years, organizations concerned, including the courts, judicial and administrative organs, and local governments, are working to build a pluralistic dispute resolution mechanism through division of labour and coordination. In order to achieve comprehensive management of public security, promote and guarantee the stability and healthy development of society, and establish a good order of the rule of law. The system of people's mediation, as one of the most critical links, has also encountered many new problems and challenges in the period of social transition, Since 2009, Lianhe Street of Luogang District of Guangzhou has made a series of positive and beneficial attempts and explorations. Luogang District Lianhe Street has established a linkage mechanism of people's mediation, administrative mediation, and judicial mediation, which provides a better platform for resolving social disputes in a timely manner. Basically realized the interaction and docking of the three tones, and achieved certain social benefits. However, the development of the people's mediation linkage mechanism in Lianhe Street encountered certain difficulties. There are some insurmountable drawbacks in the course of operation. The concept of administrative management of government leading departments still exists, and the scope of mediation and the types of disputes are mixed together. The backward concept of rule of law still deeply affects the function of the linkage mechanism. Referring to the practice and experience of mediation at home and abroad, this paper puts forward some suggestions to improve the problems existing in Luogang Lianhe Street. Starting from the basic point of maintaining social harmony and stable development and combining with the practice of the people's mediation in Luogang District of Guangzhou City, this paper makes an empirical analysis from the theoretical research. The author makes a deep research on the linkage mechanism of people's mediation from the aspects of legislative norms and practical operation. The author studies the development and research status of mediation system at home and abroad from the point of view of the people's mediation and related basic theories. In Luogang District, the construction and operation of the people's mediation linkage mechanism in Luogang District are put forward, and some suggestions are put forward to perfect the linkage mechanism of the people's mediation in Luogang District. In order to provide theoretical support for Luogang District Lianhe Street people's mediation mechanism construction and application.
