【摘要】：我國家事糾紛法院調解功能的弱化和復興,與調解政策變遷高度相關。調解解決家事糾紛的優(yōu)先性是由案件內在性質決定的,家事調解司法機能實現(xiàn)的前提是回歸調解的本質,以人際關系調整為中心,而不是以結案方式為中心。目前的家事糾紛調解實踐,存在調解人員供給不足、家事調解價值認知表面化、調解程序的規(guī)范性缺位、調解人缺乏專業(yè)訓練等問題。構建專門化的家事調解制度,將家事調解作為家事訴訟的前置性程序,應以家事調解員的專業(yè)化、調解與訴訟連續(xù)性運作、調解主體的積極性中立為程序特點。
[Abstract]:The weakening of China's mediation function of family disputes in court and revival, is highly correlated with the mediation policy changes. The priority of the mediation to resolve family disputes is determined by the intrinsic nature of the case, the premise of judicial mediation function is the realization of the nature of mediation, to adjust the interpersonal relationship as the center, rather than closed as the center at present. Family mediation practice, insufficient supply of mediators, appreciation of the value of family mediation, the absence of standardized mediation procedures, lack of professional training and other problems mediator. Construction of specialized mediation system, the program in front of the family mediation as a family litigation, should be based on the mediator's specialization, mediation and litigation continuity operation, the enthusiasm for neutral mediation subject character of the program.
