論法治政府視野下我國政府律師制度的完善

【摘要】:政府律師制度的完善,是我國法治政府建設的內(nèi)在需要,也是當前深入推進依法行政的現(xiàn)實選擇。法治政府的建設需要政府律師參與政府履行職責的各個環(huán)節(jié),提升政府依法行政的整體水平和社會公信力。我國自2002年開展政府律師制度試點工作,由于制度設計沒有妥善解決與現(xiàn)行行政管理架構(gòu)、公務員管理與律師管理制度銜接的問題,導致政府律師法律地位始終模糊,以至于試點工作也推行不暢,甚至引起對政府律師存廢的質(zhì)疑。鑒于此,對相關(guān)制度的完善進行研究,以切實發(fā)揮政府律師作用,提升政府律師地位,使我國的政府律師制度重新煥發(fā)生機,具有理論意義和現(xiàn)實意義。 本文分三個部分對我國政府律師制度的完善進行了研究。首先,對政府律師制度的源起、沿革以及我國政府律師制度現(xiàn)狀進行了介紹,并重點對法治政府建設中在我國設立政府律師的必要性進行了認真分析,以駁斥認識上的否定和懷疑之說。其次,則具體分析了我國政府律師制度存在的主要問題及原因,包括:政府律師制度尚沒有得到《律師法》的確認;職責定位與政府法制機構(gòu)職責的沖突;兼具律師與公務員的雙重身份,實行所在單位、司法行政機關(guān)、律師協(xié)會三方管理的模式,沒有與公務員管理制度有效結(jié)合,政府律師身份無從體現(xiàn)、執(zhí)業(yè)獨立性無法保障;激勵機制匱乏。最后,則針對存在的問題提出了完善我國政府律師制度的建議:在立法確定政府律師法律地位的前提下,建立政府律師身份的定向賦予制度、合理界定職責范圍、提升其待遇并優(yōu)化管理方式。 本文強調(diào),完善我國的政府律師制度,必須充分考慮與政府法制機構(gòu)的銜接,妥善處理好兩者之間的關(guān)系。在政府律師身份方面,可以定向賦予政府法制機構(gòu)工作人員;在職責界定方面,應當結(jié)合政府法制機構(gòu)專業(yè)化建設進度,考慮界定一致或者界定為專業(yè)性法律事務,并對其履行職責提供制度保障;在待遇提升上,應當建立合理的薪酬制度和優(yōu)先晉升機制,完善職稱制度并保持適度的流動性,同時提供更多的工作鍛煉機會和學習培訓機會;在管理方式上,應當構(gòu)建合理高效的政府律師管理體制,并制定專門的政府律師執(zhí)業(yè)行為規(guī)范。
[Abstract]:The perfection of the government lawyer system is the internal need of the construction of the government ruled by law in our country, and it is also the realistic choice to advance the administration by law. The construction of the government by law requires the government lawyers to participate in each link of the government to perform its duties. Improve the overall level of government administration according to law and social credibility. Since 2002, our government lawyer system pilot work, due to the system design has not been properly resolved with the current administrative structure. The problem of the connection between the civil servant management and the lawyer management system leads to the blur of the legal status of the government lawyer all the time, so that the pilot work is also implemented unobstructed, and even raises the question of the retention or abolition of the government lawyer. In view of this. It is of theoretical and practical significance to study the perfection of relevant systems in order to give full play to the role of government lawyers, to promote the status of government lawyers, and to rejuvenate the system of government lawyers in our country. This paper is divided into three parts to study the perfection of our government lawyer system. First of all, the origin of the government lawyer system, evolution and the current situation of our government lawyer system are introduced. And focus on the rule of law government in the construction of the necessity of setting up a government lawyer in our country, in order to refute the cognitive negation and doubt. Secondly. Then it analyzes the main problems and reasons of our government lawyer system, including: the government lawyer system has not been confirmed by the lawyers Law; The conflict between the duty orientation and the responsibility of the government legal institutions; The dual identity of both lawyers and civil servants, the implementation of the unit, judicial administrative organs, bar associations of the three-way management model, without effective integration with the civil service management system, the identity of government lawyers can not be reflected. The independence of practice cannot be guaranteed; Finally, in view of the existing problems, the author puts forward some suggestions to perfect the system of government lawyers: on the premise of legislation to determine the legal status of government lawyers, it establishes the system of orientation and endowing of the identity of government lawyers. Define the scope of responsibilities, improve their treatment and optimize management. This paper emphasizes that in order to perfect our government lawyer system, we must fully consider the connection with the government legal system and properly handle the relationship between them. The staff of the legal institutions of the government can be assigned to them; In the aspect of defining responsibilities, we should consider the definition of consistent or professional legal affairs in combination with the progress of the specialization construction of government legal institutions, and provide system guarantee for the performance of their duties. On the promotion of treatment, we should establish a reasonable salary system and preferential promotion mechanism, perfect the title system and maintain the appropriate mobility, at the same time, provide more work training opportunities and learning and training opportunities; In terms of management mode, we should construct a reasonable and efficient government lawyer management system, and formulate a special code of practice for government lawyers.
