【摘要】：法官員額制改革涉及法院工作人員的切身利益,如何理解并尊重利益相關(guān)方的合理訴求,妥善協(xié)調(diào)好改革各方的利益關(guān)系已成為影響員額制改革成敗的關(guān)鍵問題。為此,有必要首先對"誰參與入額競爭"的利益相關(guān)方進(jìn)行界定;其次,對入額與否進(jìn)行"成本-收益"分析,從而理性認(rèn)識員額制;再次,深入分析不同類型利益相關(guān)方,權(quán)衡利弊后,明確在競爭入額、放棄入額、辭職"離場"三種博弈策略之間進(jìn)行選擇的緣由及其激勵因素;最后,提出基于利益激勵結(jié)構(gòu)變革的員額制改革優(yōu)化,改變利益相關(guān)方的職業(yè)預(yù)期及其博弈策略選擇,以利益導(dǎo)向落實改革目標(biāo)。
[Abstract]:The reform of the post system of judges involved the personal interests of the staff of the Court and how to understand and respect the legitimate demands of the stakeholders. It is necessary to define the stakeholders who participate in the entry competition at first, which has become a key issue affecting the success or failure of the post system reform. Secondly, "cost-benefit" analysis is carried out on the input or not, so as to rationally understand the post system; Thirdly, after deeply analyzing different types of stakeholders, after weighing the advantages and disadvantages, it is clear that the reasons and incentive factors for the choice among the three game strategies of competitive income, giving up the amount of income and quitting the game of "leaving the market"; Finally, this paper puts forward the post system reform optimization based on the change of interest incentive structure, changes the career expectation of stakeholders and the choice of game strategy, and implements the reform goal with interest orientation.
