【摘要】：村落宗族勢(shì)力是隨著我國(guó)改革開放以來(lái)村落宗族制度的復(fù)興和蔓延而形成的以血緣以及姻親關(guān)系為紐帶利益相對(duì)統(tǒng)一的群體,村落宗族勢(shì)力的形成伴隨著村民自治制度的實(shí)施,二者是既對(duì)立又統(tǒng)一的關(guān)系。村落宗族勢(shì)力對(duì)村民自治制度有著雙重的影響,其積極影響主要在村民自治制度實(shí)施的過(guò)程中,為村民提供經(jīng)濟(jì)互助、協(xié)調(diào)農(nóng)村人際關(guān)系、滿足村民的公共情感和心理需求、豐富村民的日常文化生活、增強(qiáng)政府的公共權(quán)威以及為村民提供社會(huì)保障等;而村落宗族勢(shì)力對(duì)村民自治的消極影響則主要體現(xiàn)在宗族成員為本宗族謀取利益對(duì)于民主選舉、民主管理等村民自治活動(dòng)的違法干預(yù),阻礙村民自治制度的實(shí)施。因此,為了村民自治制度的順利實(shí)施,有必要對(duì)村落宗族勢(shì)力進(jìn)行適當(dāng)?shù)囊?guī)制。我國(guó)的村民自治立法在"近親屬"、"民主選舉"等方面對(duì)村落宗族勢(shì)力進(jìn)行了間接的規(guī)制,但是這些相關(guān)規(guī)定未直接指向宗族勢(shì)力對(duì)村民自治的影響,約束力不強(qiáng),作用不顯著。只有細(xì)化法律規(guī)范,提高村民自治法律的指向性和明確性,同時(shí)吸收宗族規(guī)范,挖掘宗族行為規(guī)范的現(xiàn)代法治價(jià)值,并堅(jiān)持立法與普法相結(jié)合,才能更好的規(guī)制村落宗族勢(shì)力,弱化其對(duì)村民自治制度的消極影響,轉(zhuǎn)為推動(dòng)村民自治制度在我國(guó)廣大農(nóng)村地區(qū)的實(shí)施。
[Abstract]:With the revival and spread of the village clan system since the reform and opening up in China, village clan forces are relatively unified with the interests of blood and in-laws, and the formation of village clan forces is accompanied by the implementation of the villager autonomy system. The two are both opposite and unified. The village clan forces have a double influence on the villager autonomy system. Its positive influence is mainly in the process of implementing the villager autonomy system, which provides the villagers with mutual economic assistance, coordinates the interpersonal relationship in the countryside, and satisfies the public emotion and psychological needs of the villagers. Enrich the villagers' daily cultural life, strengthen the public authority of the government and provide social security for the villagers; The negative influence of clan forces on villager autonomy is mainly reflected in the illegal interference of clan members in democratic election, democratic management and other activities of villager autonomy, which hinders the implementation of villager autonomy system. Therefore, it is necessary to regulate the clan power in order to implement the village autonomy system smoothly. The legislation of villager autonomy in our country has indirectly regulated the village clan forces in the aspects of "close relatives" and "democratic election", but these relevant regulations have not directly pointed to the influence of clan forces on villagers' autonomy, and the binding force is not strong. The effect is not significant. Only by refining the legal norms, improving the orientation and clarity of the villager autonomy law, absorbing clan norms, excavating the value of modern rule of law of clan behavior norms, and insisting on the combination of legislation and law popularization, can we better regulate the clan forces in villages. It weakens its negative influence on the villager autonomy system and turns to promote the implementation of the villager autonomy system in the vast rural areas of our country.
