【摘要】：通過對(duì)王家鎮(zhèn)四個(gè)行政村的宅基地使用權(quán)管理數(shù)據(jù)進(jìn)行分析,結(jié)合宅基地使用權(quán)實(shí)際管理工作,發(fā)現(xiàn)王家鎮(zhèn)宅基地使用權(quán)管理過程中主要存在四個(gè)方面的問題:一是廢舊宅基地增多;二是違章建房嚴(yán)重;三是存在宅基地使用權(quán)隱形交易市場;四是宅基地?fù)碛胸毟徊痪�。�?jīng)過認(rèn)真分析,查找到五點(diǎn)原因:一是農(nóng)村宅基地使用權(quán)具有嚴(yán)格的身份屬性;二是農(nóng)村宅基地使用權(quán)無法自由流轉(zhuǎn);三是王家鎮(zhèn)村莊建設(shè)用地面積小,無法滿足農(nóng)民改善住房的要求;四是宅基地指標(biāo)"僧多粥少";五是宅基地使用權(quán)具有長期性。通過對(duì)調(diào)查問卷結(jié)果進(jìn)行梳理,歸納出三種意見:一是禁止流轉(zhuǎn)。主要理由是村集體經(jīng)濟(jì)組織是宅基地所有權(quán)人,農(nóng)民只是宅基地的使用權(quán)人,其取得使用權(quán)是無償?shù)?允許流轉(zhuǎn)不但損害村集體經(jīng)濟(jì)組織的利益,同時(shí)不利于社會(huì)穩(wěn)定。二是自由流轉(zhuǎn)。主要理由是自由流轉(zhuǎn)會(huì)使農(nóng)民的房產(chǎn)增值,同時(shí)會(huì)消除流轉(zhuǎn)的隱形市場,避免發(fā)生糾紛。三是限制流轉(zhuǎn)。宅基地使用權(quán)流轉(zhuǎn)應(yīng)僅限于本集體經(jīng)濟(jì)組織內(nèi)部。這是王家鎮(zhèn)在宅基地使用權(quán)管理過程中的做法。但該觀點(diǎn)沒有突破現(xiàn)有法律框架的束縛,實(shí)際管理過程中存在的問題證明,必須對(duì)現(xiàn)有的管理模式進(jìn)行改良,將宅基地使用權(quán)的流轉(zhuǎn)分為內(nèi)外兩種情況,打破村與村之間的壁壘,擴(kuò)大內(nèi)部流轉(zhuǎn)的范圍至全鎮(zhèn),允許有條件的向王家鎮(zhèn)外部流轉(zhuǎn)。采用此種宅基地使用權(quán)流轉(zhuǎn)模式,會(huì)充分利用王家鎮(zhèn)有限的土地資源,有效遏制王家鎮(zhèn)宅基地使用權(quán)流轉(zhuǎn)的隱形市場擴(kuò)張,發(fā)揮宅基地使用權(quán)的物權(quán)效力,改變宅基地建設(shè)無序狀態(tài),加強(qiáng)其社會(huì)保障功能。但與此同時(shí),應(yīng)配套宅基地使用權(quán)流轉(zhuǎn)四種制度,即:有期限使用制度,有償使用制度,完善登記制度,建立流轉(zhuǎn)收益分配制度。
[Abstract]:Through the analysis of the management data of the right to use the homestead in the four administrative villages of Wangjia Town, combining with the actual management of the right to use the homestead, It is found that there are four main problems in the management of the right to use the homestead in Wangjia Town: first, the increase of the waste homestead; Second, serious illegal building; third, the existence of residential land use right invisible trading market; fourth, homestead has uneven wealth. After careful analysis, five reasons are found: first, the right to use the rural homestead has strict identity attributes, the other is that the right to use the rural homestead cannot be freely circulated; The third is the small area of the village construction land in Wangjia Town, which can not meet the needs of farmers to improve their housing; the fourth is the index of homestead "more than the demand for more people"; the fifth is the long-term nature of the right to use the homestead. Through combing the results of the questionnaire, three opinions are summed up: one is the prohibition of circulation. The main reason is that the village collective economic organization is the owner of the homestead, the farmer is only the right to use the homestead, its right to use is free of charge, allowing circulation not only damages the interests of the village collective economic organization, but also is not conducive to social stability. Second, free circulation. The main reason is that free circulation will increase the value of farmers' property and eliminate the invisible market and avoid disputes. Third, restrictions on circulation. The circulation of the right to use the homestead shall be limited to the interior of the collective economic organization. This is Wangjia Town in the management of the use of homestead in the process of practice. However, this view has not broken through the shackles of the existing legal framework, and the problems existing in the actual management process prove that the existing management mode must be improved, and the circulation of the right to use the homestead can be divided into two situations: internal and external. Break the barriers between villages, expand the scope of internal circulation to the whole town, allow conditional flow to the outside of Wangjia Town. Adopting this kind of circulation mode of homestead use right will make full use of the limited land resources of Wangjia Town, effectively restrain the invisible market expansion of the circulation of the right to use the homestead in Wangjia Town, and give play to the real right effect of the right to use the homestead. Change the disorder of homestead construction, strengthen its social security function. But at the same time, there should be four systems for the circulation of the right to use the homestead, that is, the system of limited use, the system of paid use, the perfection of the registration system, and the establishment of the system of distribution of circulation income.
