【摘要】：對(duì)于未成年人給予特殊的照顧和關(guān)懷是世界各國的共識(shí)。在刑事政策方面,多數(shù)國家都很重視對(duì)于未成年犯罪人的教育、矯治。我國在社會(huì)管理創(chuàng)新視域下,對(duì)于未成年人犯罪刑事政策應(yīng)當(dāng)從定罪政策、刑罰政策以及執(zhí)行政策三個(gè)方面進(jìn)行全面的改革和完善。在借鑒國外先進(jìn)立法例的前提下,結(jié)合我國的實(shí)際情況,建立符合我國國情的少年司法制度。
[Abstract]:It is the consensus of the world to give special care and care to minors. In terms of criminal policy, most countries attach great importance to the education and correction of juvenile offenders. From the perspective of social management innovation, China's criminal policy on juvenile delinquency should be comprehensively reformed and perfected from three aspects: conviction policy, penalty policy and execution policy. On the premise of drawing lessons from foreign advanced legislations and combining with the actual situation of our country, the juvenile justice system in accordance with the national conditions of our country is established.
