筆跡分析在司法實踐中運用探究

【摘要】：筆跡是人們通過書寫練習活動而形成的反映書寫人書寫技能、習慣以及性格、心理等的文字符號的形象系統(tǒng),與書寫人的人格具有一定的相關性,可以通過對筆跡的書寫特征和規(guī)律的研究,分析書寫者的性格、心理和行為方式等特點,這樣的一種特殊心理分析技術就叫做筆跡分析。筆跡分析技術在國外的研究和應用比較廣泛,在我國,研究的起步較晚,領域相對狹窄,應用的范圍和程度也有待擴展和加強。 筆跡分析在司法實踐中具有很大的實踐意義,通過筆跡分析可以刻畫犯罪人的心理性格和行為方式,為案件偵查提供線索,同時,在辨別筆跡真?zhèn)�、預防犯罪、犯人改造等方面也可以發(fā)揮作用。目前,筆跡分析在國內的司法實踐中已嶄露頭角,但是針對筆跡分析運用于司法實踐的研究還相對滯后,西方在此方面的研究值得借鑒,但是由于東西方字跡的區(qū)別以及人格差異的存在,其研究結論的可參考程度有所降低。所以,本文擬從實證數(shù)據(jù)研究的角度,探討筆跡與人格之間的關系,以及筆跡分析在司法實踐中的運用方法和價值。 全文共有四個部分: 第一部分主要探討了筆跡分析的概念內涵及研究價值。在結合筆跡的概念、理清筆跡學、筆跡鑒定、筆跡分析三個概念關系的基礎上得出筆跡分析的概念內涵。根據(jù)筆跡特征對人格的表達性和筆跡特征的相對穩(wěn)定的再現(xiàn)性或規(guī)律性,剖析筆跡分析理論的原理。簡要介紹了筆跡分析目前在司法實踐中運用的比較少的原因,以及筆跡分析在司法實踐中的運用價值,得出本文研究的主題具有重要意義。 第二部分主要對國內外筆跡分析技術的研究和運用狀況做了簡要的綜述。分別介紹了國外筆跡分析技術研究情況、研究結果以及實踐運用情況,我國古代筆跡分析人格的思想淵源、近些年筆跡分析研究結果和實踐運用情況。 第三部分主要是通過實證研究探討筆跡與書寫人性別、人格的關系。實驗對60名在校學生的筆跡進行觀察,選取一系列筆跡特征進行量化處理,然后運用T檢驗和spearman等統(tǒng)計分析方法,將其與這些被試者的艾森克人格測試分值進行相關性研究,從而發(fā)現(xiàn)筆跡與性別、筆跡與人格之間的關系。結論包括三部分,分別是筆跡特征的性別差異、男性筆跡特征與人格關系、女性筆跡特征與人格關系。 第四部分主要闡述了司法實踐中筆跡分析的方法與運用。筆跡分析方法的闡述按照其流程主要包括三個方面,首先是介紹筆跡分析材料的來源與要求,其次說明筆跡分析的步驟與方法,再次是筆跡分析意見的形成。筆跡分析在司法實踐中運用的內容有:判斷和刻畫行為人性別和人格、結合筆跡鑒定發(fā)現(xiàn)偽裝、犯罪預防和犯人改造,在闡述運用筆跡分析技術刻畫行為人人格的部分,還選取了50位獄內犯人筆跡與普通在校大學生筆跡做了特征數(shù)據(jù)比對,得出了盜竊犯罪人和暴力犯罪人筆跡特征特點。最后,對筆跡分析技術相對局限性做了分析,提出在司法實踐中運用時應給予重視。
[Abstract]:The handwriting is an image system that reflects the writing skills , habits and characters , psychology and so on of the writer through writing exercises . It has a certain correlation with the author ' s personality . This kind of special psychological analysis technique is called handwriting analysis . The research and application of handwriting analysis technology are widely used in foreign countries . In China , the research starts late , the field is relatively narrow , and the scope and extent of application are also to be expanded and strengthened .
The handwriting analysis is of great practical significance in judicial practice , and it can be used as a clue to the investigation of cases . However , the study of handwriting analysis in the practice of judicial practice has become more and more important . At present , the study of handwriting analysis in the practice of judicial practice has lagged behind . However , this paper intends to explore the relationship between handwriting and personality , as well as the application method and value of handwriting analysis in judicial practice due to the differences of handwriting analysis and personality differences .
The full text has four parts :
The first part mainly discusses the concept connotation and the research value of the handwriting analysis . Based on the concept of handwriting , the author draws the concept connotation of handwriting analysis on the basis of three concepts of handwriting analysis , handwriting identification and handwriting analysis . The paper briefly introduces the reasons why the handwriting analysis is used in judicial practice and the application value of handwriting analysis in judicial practice , and concludes that the subject of this paper is of great significance .
The second part gives a brief review of the research and application of handwriting analysis technology at home and abroad .
The third part mainly discusses the relationship between handwriting and writing human ' s gender and personality through empirical research .
The fourth part mainly expounds the method and application of handwriting analysis in judicial practice .
