【摘要】：黑社會(huì)犯罪是一種具有特殊社會(huì)危害性的犯罪類型，從犯罪學(xué)的角度來(lái)看，黑社會(huì)犯罪不僅指新刑法第294條所規(guī)定的罪名，而且應(yīng)當(dāng)包括黑社會(huì)組織及其成員實(shí)施的其他犯罪在內(nèi)。因此，本文所稱黑社會(huì)犯罪是指涉及黑社會(huì)組織的一切犯罪行為。 以黑社會(huì)犯罪的概念為基點(diǎn)，本文揭示了黑社會(huì)犯罪的六個(gè)基本特征，即嚴(yán)密的組織性，手段的暴力性，經(jīng)濟(jì)目的性，壟斷性，對(duì)公權(quán)力的腐蝕性和文化同質(zhì)性。同時(shí)，結(jié)合我國(guó)當(dāng)前黑社會(huì)犯罪的現(xiàn)狀，探析了黑社會(huì)犯罪在未來(lái)的四大發(fā)展趨勢(shì)，以期能引起政府和社會(huì)各界的關(guān)注。 在文章的第二部分，即黑社會(huì)犯罪產(chǎn)生的成因上，本文以社會(huì)學(xué)、犯罪學(xué)以及刑法學(xué)理論為視角，分析了黑社會(huì)犯罪之產(chǎn)生根源。黑社會(huì)犯罪在我國(guó)的滋生和蔓延，既有經(jīng)濟(jì)和社會(huì)原因，又有法制不健全的原因，還有犯罪亞文化等意識(shí)上的原因，它是多種社會(huì)因素相結(jié)合的產(chǎn)物。 基于對(duì)黑社會(huì)犯罪原因的透析與把握，，文章從宏觀社會(huì)政策、道德意識(shí)、法制、社會(huì)管理以及微觀刑事偵控五個(gè)層面提出了治理黑社會(huì)犯罪的對(duì)策。并認(rèn)為，黑社會(huì)犯罪并非不治之癥，只要我們認(rèn)真做好道德預(yù)防，社會(huì)預(yù)防和法律預(yù)防，搞好社會(huì)治安綜合治理，黑社會(huì)犯罪就必將得到有效控制并減少，直至消滅。
[Abstract]:Underworld crime is a type of crime with special social harmfulness. From the perspective of criminology, underworld crime not only refers to the crimes stipulated in Article 294 of the new Criminal Law. And it should include other crimes committed by the underworld organizations and their members. Therefore, the underworld crimes referred to in this paper refer to all the criminal acts involving the underworld organizations. Based on the concept of underworld crime, this paper reveals six basic characteristics of underworld crime, that is, strict organization, violence of means, economic purpose, monopoly, corrosiveness to public power and cultural homogeneity. Combined with the present situation of the underworld crime in our country, this paper probes into the four development trends of the underworld crime in the future, in order to arouse the attention of the government and all circles of the society. In the second part of the article, that is, the cause of formation of the underworld crime, this paper analyzes the origin of the underworld crime from the angle of sociology, criminology and criminal law theory, the breeding and spreading of the underworld crime in our country. There are not only economic and social reasons, but also the reasons of imperfect legal system, as well as the consciousness of criminal subculture, which is the result of the combination of many kinds of social factors. Based on the analysis and grasp of the causes of the underworld crime, this paper puts forward the countermeasures of controlling the underworld crime from the macro social policy, the moral consciousness, the legal system, the social management and the micro criminal investigation and control. Triad crime is not an incurable disease. As long as we do moral prevention, social prevention and legal prevention, and do a good job of comprehensive management of social security, triad crimes will be effectively controlled and reduced until they are eliminated.
