【摘要】： 本文通過(guò)對(duì)森林公安機(jī)關(guān)執(zhí)法活動(dòng)和隊(duì)伍建設(shè)等情況的分析、研究,以加強(qiáng)森林公安組織機(jī)構(gòu)的正規(guī)化建設(shè),確保森林資源安全為目的,從森林公安體制的歷史演變及其改革研究的背景入手,在總結(jié)了森林公安機(jī)關(guān)綜合執(zhí)法情況的基礎(chǔ)上,剖析了森林公安機(jī)關(guān)現(xiàn)行體制的弊端及其森林公安建設(shè)存在問(wèn)題,探索如何加強(qiáng)森林公安體制改革和對(duì)策的研究,做出結(jié)論并提出了建議,以便進(jìn)一步提高和規(guī)范我國(guó)森林公安機(jī)關(guān)綜合執(zhí)法能力,保護(hù)好我國(guó)森林資源和野生動(dòng)植物資源的安全,創(chuàng)造和諧的生態(tài)環(huán)境。 1.森林公安機(jī)關(guān)是作為公安機(jī)關(guān)派駐林業(yè)部門的武裝性質(zhì)的治安行政和刑事司法力量,肩負(fù)著保護(hù)森林和野生動(dòng)植物資源安全,維護(hù)林區(qū)社會(huì)治安秩序,保障林業(yè)建設(shè)和改革順利進(jìn)行的重任,為創(chuàng)造社會(huì)主義和諧社會(huì)做出重要貢獻(xiàn)的一支重要力量。 2.森林公安機(jī)關(guān)綜合執(zhí)法的調(diào)查:全國(guó)森林公安機(jī)關(guān)20年來(lái)共受理森林及野生動(dòng)物案件225萬(wàn)起,查處217萬(wàn)起,受理行政案件206.7萬(wàn)起,處理行政案件187.9萬(wàn)起,破獲刑事案件14.2萬(wàn)起,破獲重特大案件3萬(wàn)余起,共打擊處理各類違法犯罪人員327.8萬(wàn)人次,收繳木材697萬(wàn)立萬(wàn)米,收繳野生動(dòng)物925.1萬(wàn)只(頭),為國(guó)家挽回經(jīng)濟(jì)損失53.2億元。 3.通過(guò)加強(qiáng)森林公安基層基礎(chǔ)工作,實(shí)行森林公安省、市級(jí)垂直管理將有利于森林公安隊(duì)伍建設(shè)與管理,提高戰(zhàn)斗力,加大森林資源的保護(hù)力度,最大限度地發(fā)揮人員、機(jī)構(gòu)的作用,以適應(yīng)日益繁重的生態(tài)建設(shè)工作任務(wù)的需要,嚴(yán)厲打擊各種破壞森林資源的違法犯罪分子,為保護(hù)森林資源安全做出貢獻(xiàn)。
[Abstract]:Based on the analysis of law enforcement activities and troop construction of forest public security organs, this paper aims at strengthening the formalization of forest public security organizations and ensuring the safety of forest resources. Starting from the historical evolution of the forest public security system and the background of the research on the reform, this paper summarizes the comprehensive law enforcement situation of the forest public security organ, analyzes the drawbacks of the present system of the forest public security organ and the existing problems in the forest public security construction. This paper explores how to strengthen the research of forest public security system reform and countermeasures, draws conclusions and puts forward some suggestions, in order to further improve and standardize the comprehensive law enforcement capacity of our country's forest public security organs. Protect the safety of forest resources and wildlife resources and create a harmonious ecological environment. 1. Forest public security organs are armed security administrative and criminal judicial forces accredited to forestry departments as public security organs, shouldering the responsibility of protecting the security of forest and wildlife resources and maintaining public order and order in forest areas. The important task of ensuring forestry construction and reform is an important contribution to the creation of a harmonious socialist society. 2. Investigation of comprehensive law enforcement by forest public security organs: in the past 20 years, forest public security organs throughout the country have accepted 2.25 million forest and wildlife cases, dealt with 2.17 million cases, accepted 2.067 million administrative cases and handled 1.879 million administrative cases. More than 142000 criminal cases were cracked down, more than 30, 000 major cases were cracked down, 3.278 million people were dealt with various types of illegal and criminal personnel, 6.97 million million meters of timber was seized, and 9.251 million wild animals were seized. 3. Through strengthening the basic work of forest public security at the grass-roots level, carrying out the forest public security province, the vertical management at the municipal level will be beneficial to the construction and management of the forest public security contingent, enhance the combat effectiveness, strengthen the protection of forest resources, and give full play to the personnel. The role of the organization, in order to meet the needs of the increasingly heavy task of ecological construction, severely crack down on all kinds of illegal and criminal elements who destroy forest resources, and contribute to the protection of forest resources security.
