【摘要】：隨著國民經(jīng)濟的快速發(fā)展和現(xiàn)代化建設(shè)步伐的日益加快,建設(shè)項目的規(guī)模不斷擴大,復(fù)雜程度不斷提高,技術(shù)難度不斷增加,從而導(dǎo)致在建設(shè)項目的具體實施過程中,建筑施工企業(yè)所面臨的不確定因素逐步增多,由此產(chǎn)生的風(fēng)險也逐步加大。在市場經(jīng)濟環(huán)境下,承發(fā)包雙方權(quán)利義務(wù)主要通過雙方簽訂的施工合同來確定。因此,如何有效地防范和控制施工合同風(fēng)險,關(guān)系著每個企業(yè)的生存和發(fā)展。 本文站在建筑施工企業(yè)的角度,參考目前常用的風(fēng)險管理理論和合同管理方法,對建筑施工企業(yè)的施工合同風(fēng)險管理過程進行了分析和研究。把施工合同風(fēng)險分為主觀性合同風(fēng)險和客觀性合同風(fēng)險兩大類,指出了我國施工企業(yè)在合同風(fēng)險管理方面的不足以及如何加強和改進合同管理工作,提出了進行施工合同風(fēng)險管理的基本流程,并對流程中各個環(huán)節(jié)的概念、步驟和方法等進行了詳細的說明。最后,結(jié)合工程案例進行分析,對該項目施工合同風(fēng)險管理工作中出現(xiàn)的一系列問題提出了切實可行的應(yīng)對方案。 希望通過本論文的探討,可以提高我國建筑施工企業(yè)對于施工合同風(fēng)險管理重要性的認識,在合同風(fēng)險管理上下功夫,不斷總結(jié)積累經(jīng)驗,形成一套適合本企業(yè)的方法體系,為企業(yè)在日后開展風(fēng)險管理工作提供幫助。
[Abstract]:With the rapid development of the national economy and the acceleration of the pace of modernization, the scale of the construction project is constantly expanding, the degree of complexity is increasing, and the technical difficulty is increasing, which leads to the concrete implementation process of the construction project. The uncertainties faced by construction enterprises are gradually increasing, and the risks arising therefrom are gradually increased. In the market economy environment, the rights and obligations of the contracting parties are mainly determined by the construction contracts signed by the two parties. Therefore, how to effectively prevent and control the construction contract risk is related to the survival and development of each enterprise. From the point of view of construction enterprises and referring to the theory of risk management and the methods of contract management, this paper analyzes and studies the process of construction contract risk management in construction enterprises. This paper divides the construction contract risk into two categories: subjective contract risk and objective contract risk, and points out the deficiency of contract risk management in Chinese construction enterprises and how to strengthen and improve the contract management. The basic flow of construction contract risk management is put forward, and the concepts, steps and methods of each link in the process are explained in detail. Finally, a series of problems in the construction contract risk management of the project are analyzed, and some feasible solutions are put forward. It is hoped that through the discussion of this paper, we can improve the understanding of the importance of construction contract risk management in Chinese construction enterprises, make great efforts in contract risk management, continuously sum up the accumulated experience, and form a set of method system suitable for this enterprise. To provide assistance for the enterprise to carry out risk management work in the future.
