現(xiàn)代農(nóng)業(yè)發(fā)展背景下如何使農(nóng)地“三權(quán)分置”更有效——基于產(chǎn)權(quán)結(jié)構(gòu)細(xì)分的約束及其組織治理的研究

【摘要】:本文圍繞"如何才能使農(nóng)地‘三權(quán)分置’是有效的"命題,從現(xiàn)代農(nóng)業(yè)發(fā)展背景下農(nóng)地產(chǎn)權(quán)結(jié)構(gòu)細(xì)分對(duì)"三權(quán)分置"構(gòu)成的約束及其組織治理的角度進(jìn)行研究。結(jié)果發(fā)現(xiàn),(1)在農(nóng)業(yè)生產(chǎn)特點(diǎn)下,家庭經(jīng)營(yíng)的重要性使得需要除去人身屬性進(jìn)而以財(cái)產(chǎn)權(quán)性質(zhì)流動(dòng)的農(nóng)地使用權(quán)細(xì)分要求,對(duì)農(nóng)地承包權(quán)和經(jīng)營(yíng)權(quán)的分置構(gòu)成了分置結(jié)果上的兩難約束;(2)農(nóng)業(yè)發(fā)展本身對(duì)農(nóng)地處分權(quán)從流轉(zhuǎn)權(quán)到抵押權(quán)細(xì)分的內(nèi)在要求,對(duì)農(nóng)地承包權(quán)和經(jīng)營(yíng)權(quán)的分置也構(gòu)成了方式選擇上的實(shí)質(zhì)約束;(3)面對(duì)上述雙重約束,農(nóng)地股份合作社是在治理上實(shí)現(xiàn)農(nóng)地"三權(quán)分置"的有效組織途徑,同時(shí)也是構(gòu)建新型農(nóng)業(yè)經(jīng)營(yíng)體系和促進(jìn)農(nóng)業(yè)產(chǎn)業(yè)化發(fā)展的重要路徑。啟示在于,在通過(guò)農(nóng)地經(jīng)營(yíng)權(quán)流動(dòng)與集中、建立和發(fā)展多種農(nóng)業(yè)經(jīng)營(yíng)主體的同時(shí),需要保障農(nóng)戶家庭經(jīng)營(yíng)的主體地位,并加強(qiáng)與其他主體、新型農(nóng)業(yè)社會(huì)化服務(wù)組織之間的合作共贏;同時(shí),在當(dāng)前農(nóng)地抵押貸款機(jī)制的設(shè)計(jì)與探索中要注意到農(nóng)地流轉(zhuǎn)對(duì)農(nóng)地經(jīng)營(yíng)權(quán)抵押的影響會(huì)因流轉(zhuǎn)方式的不同而變化。在當(dāng)前制度環(huán)境下,農(nóng)地入股的物權(quán)流轉(zhuǎn)可能保障農(nóng)地抵押權(quán)實(shí)現(xiàn)。如何更好建立與發(fā)展農(nóng)地股份合作社是值得探索的一個(gè)重要方向。
[Abstract]:This paper focuses on the proposition that how to make the farmland 'three rights divided' is effective. From the perspective of the subdivision of farmland property right structure and its organizational governance under the background of modern agricultural development, this paper studies the constraints of the structure of the 'three rights' division of farmland and its organizational governance. The results show that under the characteristics of agricultural production, the importance of household management makes it necessary to remove the personal attributes and then flow with the nature of property rights. The separation of the right to contract and the right to operate the farmland constitutes the dilemma of the result of the division) the inherent requirement of the agricultural development itself for the disposition right of agricultural land from circulation right to mortgage subdivision. The split structure of the right to contract and the right to operate the farmland also constitutes the substantive constraint in the choice of the mode. (3) in the face of the above dual constraints, the agricultural land stock cooperative is an effective organization way to realize the "three rights division" in the management of agricultural land. At the same time, it is also an important way to construct new agricultural management system and promote the development of agricultural industrialization. The enlightenment lies in the need to protect the principal position of household management of farmers and to strengthen their relationship with other subjects, while establishing and developing diversified agricultural management subjects through the flow and concentration of the right to operate agricultural land. At the same time, in the design and exploration of the current agricultural land mortgage loan mechanism, we should pay attention to the impact of agricultural land transfer on farmland management rights mortgage. Under the current system environment, the real right transfer of farmland shares may guarantee the realization of farmland mortgage. How to better establish and develop agricultural land stock cooperatives is an important direction worth exploring.
