【摘要】：在我國(guó)，城管執(zhí)法是行政執(zhí)法體制改革的成果，城管行政執(zhí)法程序更是行政執(zhí)法程序不可或缺的一部分。完善城管行政執(zhí)法程序能夠規(guī)范行政執(zhí)法行為，實(shí)現(xiàn)行政執(zhí)法程序公正。隨著我國(guó)城市化進(jìn)程的加快，我國(guó)的城管行政執(zhí)法涌現(xiàn)出許多問(wèn)題，究其原因是我國(guó)城管行政執(zhí)法程序在立法上和執(zhí)法中存在諸多缺陷。因此，完善城管行政執(zhí)法程序很有必要。 論文分為四大部分：第一部分對(duì)城管行政執(zhí)法程序內(nèi)涵及其主要內(nèi)容進(jìn)行了梳理，，并介紹了城管行政執(zhí)法程序與一般行政執(zhí)法程序的異同，本部分是論文寫(xiě)作的基礎(chǔ)性?xún)?nèi)容；第二部分重點(diǎn)揭示了城管行政執(zhí)法程序在實(shí)施過(guò)程中呈現(xiàn)出的立法問(wèn)題和執(zhí)法問(wèn)題，包括在立法上缺乏統(tǒng)一的城管行政執(zhí)法程序法典、現(xiàn)有法律中簡(jiǎn)易程序的規(guī)制不合理、一般程序規(guī)定得不明確、聽(tīng)證程序規(guī)定得不健全以及在執(zhí)行中存在的程序違法問(wèn)題等；第三部分對(duì)存在問(wèn)題的原因進(jìn)行了探討，從立法和執(zhí)法兩個(gè)層面進(jìn)行分析；最后一部分為我國(guó)城管行政執(zhí)法程序的完善，針對(duì)文中第二部分城管行政執(zhí)法程序存在的問(wèn)題提出了改善建議，包括在立法上制定全國(guó)統(tǒng)一的城管行政執(zhí)法程序法典、完善現(xiàn)有的簡(jiǎn)易程序、明確一般程序、健全聽(tīng)證程序和在執(zhí)法中嚴(yán)格遵守城管行政執(zhí)法程序。這也是論文研究的最終落腳點(diǎn)。
[Abstract]:In China, urban management law enforcement is the result of the reform of administrative law enforcement system, and the urban management administrative law enforcement procedure is an indispensable part of administrative law enforcement procedure. Perfecting the administrative law enforcement procedure of urban management can standardize the administrative law enforcement behavior and realize the fairness of the administrative law enforcement procedure. With the acceleration of urbanization in our country, there are many problems in the administrative law enforcement of urban management in China. The reason is that there are many defects in the legislation and law enforcement of the administrative law enforcement procedure of urban management in our country. Therefore, it is necessary to perfect the administrative law enforcement procedure of urban management. The thesis is divided into four parts: in the first part, the connotation and main contents of urban management administrative law enforcement procedure are combed, and the similarities and differences between urban management administrative law enforcement procedure and general administrative law enforcement procedure are introduced. This part is the basic content of the thesis writing; The second part focuses on revealing the legislative problems and law enforcement problems in the process of the implementation of urban management administrative law enforcement procedure, including the lack of a unified law enforcement procedure code in the legislation, and the unreasonable regulation of summary procedure in the existing laws. The general procedure is not clear, the hearing procedure is not perfect and the illegal procedure exists in the implementation. The third part discusses the reasons of the problems, and analyzes the problems from the two aspects of legislation and law enforcement. The last part is the perfection of the administrative law enforcement procedure of urban management in our country. In view of the problems existing in the administrative law enforcement procedure of urban management in the second part of this paper, the author puts forward some suggestions for improvement, including the enactment of the unified law enforcement procedure code of urban management administration in the whole country in legislation. Perfect the existing summary procedure, clear the general procedure, perfect the hearing procedure and strictly abide by the law enforcement procedure in the law enforcement. This is also the final foothold of the thesis.
