【摘要】：當(dāng)今社會(huì)霧霾日益嚴(yán)重,環(huán)境保護(hù)已經(jīng)成為全社會(huì)共同的話(huà)題,對(duì)于環(huán)境和生態(tài)的保護(hù)是人類(lèi)共同面對(duì)的問(wèn)題。環(huán)境利益事關(guān)每個(gè)生活在環(huán)境中的人的生命、健康,具有公共性,因此廣大“公眾”參與環(huán)境保護(hù),維護(hù)環(huán)境利益是必須的。從公眾參與環(huán)境保護(hù)的角度來(lái)說(shuō),“公眾”是環(huán)境法中相當(dāng)重要的概念,環(huán)境問(wèn)題的解決也需要公眾的參與,因此對(duì)于“公眾”這一概念進(jìn)行分析是研究環(huán)境法的一項(xiàng)重要任務(wù)。然而,“公眾”一詞最開(kāi)始并不是應(yīng)用在環(huán)境法領(lǐng)域,而是隨著環(huán)境問(wèn)題的加劇而逐漸應(yīng)用到環(huán)境法領(lǐng)域的。本文在進(jìn)行研究時(shí),先從其他學(xué)科來(lái)分析“公眾”的一般理論,進(jìn)而分析環(huán)境法中的“公眾”,研究域外的環(huán)境法律關(guān)于“公眾”的理論并進(jìn)而在結(jié)合我國(guó)實(shí)際的基礎(chǔ)上借鑒其先進(jìn)理論制度,然后分析我國(guó)環(huán)境法中關(guān)于“公眾”的現(xiàn)狀,發(fā)現(xiàn)其中的不足并提出完善建議,促進(jìn)公眾參與環(huán)境保護(hù),避免“搭便車(chē)”的行為。本文分四個(gè)部分介紹了環(huán)境法上的“公眾”,分別從“公眾”的一般理論、典型域外環(huán)境法律中關(guān)于“公眾”的規(guī)定以及相關(guān)理論、我國(guó)環(huán)境法律中對(duì)“公眾”的規(guī)定及其不足之處,最后從自然人、法人、環(huán)保組織、政府機(jī)構(gòu)四個(gè)角度出發(fā),來(lái)介紹在我國(guó)的環(huán)境法律中應(yīng)如何明確“公眾”的范圍,提高“公眾”參與環(huán)境事務(wù)決策的積極性與主動(dòng)性,為擁有健康的生活、生態(tài)環(huán)境做貢獻(xiàn)。本文最主要的目的在于通過(guò)對(duì)各個(gè)學(xué)科以及其他國(guó)家的“公眾”的理論進(jìn)行研究分析,從中總結(jié)理論經(jīng)驗(yàn)為我國(guó)環(huán)境法中的“公眾”的界定提供一個(gè)指引方向,從而得以確定“公眾”的外延,使得“公眾”更加積極主動(dòng)參與環(huán)境保護(hù)工作。綜上,本文從上述四個(gè)方面對(duì)“公眾”的概念進(jìn)行闡述,希望能夠促進(jìn)公眾積極參與環(huán)境保護(hù),但是由于理論水平有限,可能在對(duì)“公眾”的范圍進(jìn)行分析時(shí)有不盡完善之處,許多觀點(diǎn)也只是個(gè)人觀點(diǎn),尚不成熟,有待指正。
[Abstract]:Nowadays, haze is becoming more and more serious, environmental protection has become a common topic in the whole society, and the protection of environment and ecology is a common problem for human beings. The environmental interest is related to the life, health and publicity of every person living in the environment, so it is necessary for the "public" to participate in the environmental protection and safeguard the environmental interests. From the perspective of public participation in environmental protection, "public" is a very important concept in environmental law, and the solution of environmental problems also requires public participation. Therefore, the analysis of the concept of "public" is an important task in the study of environmental law. However, the term "public" was not used in the field of environmental law at first, but gradually applied to the field of environmental law with the aggravation of environmental problems. In this paper, we first analyze the general theory of "public" from other disciplines, and then analyze the "public" in environmental law. This paper studies the theory of "public" in overseas environmental law and draws lessons from its advanced theoretical system on the basis of combining with our country's reality, then analyzes the present situation of "public" in environmental law of our country, finds out the deficiency in it and puts forward some suggestions to perfect it. Promote public participation in environmental protection and avoid hitchhiking. This paper introduces the "public" in environmental law in four parts, including the general theory of "public", the regulations of "public" in typical extraterritorial environmental laws, and the relevant theories. Finally, from four angles of natural person, legal person, environmental protection organization and government organization, this paper introduces how to define the scope of "public" in environmental law of our country. Improve the enthusiasm and initiative of "public" participation in environmental decision-making, and contribute to a healthy life and ecological environment. The main purpose of this paper is to provide a guiding direction for the definition of "public" in China's environmental law by studying and analyzing the theories of "public" in various disciplines and other countries. Thus, the extension of "public" can be determined, and the "public" can take an active part in environmental protection. In summary, this paper expounds the concept of "public" from the above four aspects, hoping to promote the public's active participation in environmental protection, but due to the limited theoretical level, it may not be perfect in the analysis of the scope of "public". Many views are only personal views, not yet mature, yet to be corrected.
