【摘要】：伴隨人體器官移植技術(shù)的發(fā)展進(jìn)步和人體器官來(lái)源的供不應(yīng)求,買(mǎi)賣人體器官的現(xiàn)象日益泛濫,人體器官買(mǎi)賣合法化問(wèn)題成為學(xué)界討論的熱點(diǎn)。結(jié)合當(dāng)前社會(huì)現(xiàn)實(shí),期望在厘清圍繞這一問(wèn)題產(chǎn)生的傳統(tǒng)爭(zhēng)議基礎(chǔ)上,通過(guò)引進(jìn)人體器官法律屬性分析和人體器官買(mǎi)賣社會(huì)效應(yīng)分析作為新的分析進(jìn)路,梳理概括其他國(guó)家的實(shí)踐經(jīng)驗(yàn),探明和論證買(mǎi)賣人體器官的合法性基礎(chǔ),從而為國(guó)家制定法律和政策以規(guī)范人體器官應(yīng)用和推動(dòng)器官移植技術(shù)發(fā)展提供思考。
[Abstract]:With the development of human organ transplantation technology and the shortage of human organ sources, the phenomenon of buying and selling human organs has become increasingly widespread, and the legalization of human organs has become a hot topic in academic circles. Combined with the current social reality, it is expected that, on the basis of clarifying the traditional disputes surrounding this issue, the analysis of the legal attributes of human organs and the analysis of the social effects of buying and selling human organs will be adopted as a new analytical approach. This paper summarizes the practical experience of other countries, and explores and demonstrates the legal basis for the sale and sale of human organs, thus providing some thoughts for the country to formulate laws and policies to standardize the application of human organs and to promote the development of organ transplantation technology.
