【摘要】：對于愈演愈烈的非法利用個人金融信息現(xiàn)象,無論是刑事立法抑或刑事司法,均進行了較為嚴(yán)厲甚至嚴(yán)苛的規(guī)制。但我們絕不能因懲治非法利用個人金融信息行為而阻滯了金融信息的正常披露、采集與傳播。故而在動用刑法規(guī)制非法利用個人金融信息行為過程中,應(yīng)注意把握好刑法規(guī)制的限度。個人金融信息保護與信息披露的沖突與制衡實際上決定了刑法對非法利用個人金融信息行為的規(guī)制限度。非法利用個人金融信息行為的刑法規(guī)制應(yīng)當(dāng)遵循不得侵犯公民個人合法權(quán)益和不能阻滯金融信息的合理使用與傳播這兩個原則。在上述原則的制約下,刑法在規(guī)制非法利用個人金融信息行為時應(yīng)注意把握好行為和情節(jié)這兩個標(biāo)準(zhǔn),只有當(dāng)非法利用個人金融信息行為同時符合這兩個標(biāo)準(zhǔn)時,方可將其納入刑法規(guī)制范疇。目前對非法利用個人金融信息行為刑法規(guī)制具體標(biāo)準(zhǔn)的設(shè)置或限定,應(yīng)主要落實到對侵犯公民個人信息罪的具體適用標(biāo)準(zhǔn)的限定上。
[Abstract]:The phenomenon of the growing illegal use of the personal financial information, whether the criminal legislation or the criminal justice, has been more severe and even more severe. But we must not block the normal disclosure, collection and dissemination of financial information by punishing the illegal use of personal financial information. Therefore, in the process of making illegal use of individual financial information by using the law of punishment, it is necessary to pay attention to the limit of the system of the execution of the law. The conflict and balance of personal financial information protection and information disclosure actually determines the regulation limit of the criminal law to the illegal use of the individual's financial information. The legal system of the illegal use of the individual's financial information should be based on the two principles that should not violate the legitimate rights and interests of the citizens and the rational use and dissemination of the financial information. Under the restriction of the above-mentioned principle, the criminal law should pay attention to the two standards of good behavior and plot in the regulation of the illegal use of the individual financial information. Only when the illegal use of the individual financial information is in accordance with the two standards, the criminal law can be included in the legal system. At present, the setting or limitation of the specific standard for the illegal use of the individual financial information acts and regulations shall be mainly implemented in the definition of the specific application standard for the crime of the personal information of the citizen.
