【摘要】：隨著近年來信息傳播的便捷、快速化以及民眾法律意識的不斷增強,民意和輿論對刑事司法活動、特別是量刑活動的影響越來越大。這種影響往往不能避免,且具有一定合理性。通過對比和辨析,我們發(fā)現(xiàn)民意與輿論其實是兩個有差異性的概念,輿論并不一定代表真實的民意。而只有真實的民意才會對量刑產(chǎn)生積極和正面的影響,所以,要實現(xiàn)公正量刑就必須建立起行之有效的民意收集、篩選機制和輿論引導機制,以保證民意的真實性。 首先,就民意與輿論的概念來說,廣義輿論與民意的含義大致相同,本質(zhì)上均是指民眾的意見；而本文所討論的狹義輿論僅指“媒體輿論”,強調(diào)的是媒體在輿論形成中的傳播、綜合作用。在這個前提下,二者的關(guān)系更多的體現(xiàn)為輿論表達并且反作用于民意。具體到刑事司法語境下,二者則更多地體現(xiàn)出刑事相關(guān)性。其次,文章通過對民意與輿論影響量刑典型案例的分析,總結(jié)出受影響案件的特征,并在受影響與未受影響案例的對比分析中找出限制量刑受民意、輿論影響的因素。再次,在上述案例分析的基礎上,分析涉刑民意案例中民意與輿論影響量刑的作用機制、本質(zhì)和后果,其中,輿論對量刑的影響在很大程度上體現(xiàn)為媒體對量刑的影響。最后,文章在肯定民意與輿論給量刑帶來了積極后果的前提下,進一步提出如何規(guī)避負面影響以及量刑實踐中如何應對民意與輿論的正確措施,具體包括明確民意與輿論適用案件的范圍、建立規(guī)范化的民意收集、處理制度、建立有效的輿論引導機制以及及時統(tǒng)一的民意與輿論回應機制。
[Abstract]:With the rapid development of information transmission in recent years, the influence of public opinion and public opinion on the criminal justice activities, especially the sentencing activities, has become more and more important. This effect is often unavoidable and justified. By contrast and analysis, we find that public opinion and public opinion are actually two different concepts, and public opinion does not necessarily represent the real public opinion. Only the real public opinion will have a positive and positive effect on the sentencing, so it is necessary to establish an effective public opinion collection, screening mechanism and public opinion guiding mechanism to ensure the authenticity of the public opinion. First, in terms of the concept of public opinion and public opinion, the meaning of the general public opinion and the public opinion is generally the same as the public opinion, and the narrow public opinion as discussed herein refers to the "media public opinion" only, and it is emphasized that the media's communication in the formation of public opinion is the comprehensive way On this premise, the relationship between the two is more embodied as the expression of public opinion and the reaction of the people In that context of criminal justice, both of them embody the criminal correlation. Secondly, through the analysis of the typical case of the impact of the public opinion and the public opinion, the article summarizes the characteristics of the affected cases, and finds out the cause of the influence of the public opinion and the public opinion in the comparative analysis of the affected and the non-affected cases. Thirdly, on the basis of the above-mentioned case analysis, the mechanism, nature and consequence of the influence of public opinion and public opinion on the sentencing of public opinion and public opinion are analyzed. In the end, the paper further puts forward how to avoid the negative influence and how to deal with the correct measures of public opinion and public opinion in sentencing practice, including clear public opinion and the case of public opinion application.
