【摘要】：從被害人視角考察,我國(guó)《刑法》中傳播性病罪的立法目的是為了維護(hù)社會(huì)管理秩序,然而性病的廣泛傳播現(xiàn)實(shí)與此目的發(fā)生了脫離。不僅如此,司法實(shí)踐中對(duì)傳播性病罪的適用也與現(xiàn)實(shí)境況出現(xiàn)倒掛現(xiàn)象。同樣,被害人信條學(xué)在傳播性病罪中也沒(méi)有發(fā)揮出其目的論的縮限功能。因此,針對(duì)傳播性病罪而言,我們應(yīng)當(dāng)將其立法目的回歸為對(duì)被害人生命健康權(quán)益的保護(hù),摒棄無(wú)視被害人的法律家長(zhǎng)主義的傳統(tǒng)思維,從而對(duì)我國(guó)《刑法》第360條予以重新建構(gòu)。
[Abstract]:From the perspective of victims, the legislative purpose of the crime of spreading sexually transmitted diseases in the Criminal Law of our country is to maintain the order of social management, but the reality of widespread dissemination of sexually transmitted diseases is divorced from this purpose. Not only that, the application of the crime of spreading diseases in judicial practice is also inversely linked to the real situation. Similarly, victim creed does not play the role of teleology in the crime of spreading sexually transmitted diseases. Therefore, as far as the crime of spreading diseases is concerned, we should return its legislative purpose to the protection of the rights and interests of the victim's life and health, abandon the traditional thinking of neglecting the legal paternalism of the victim, and thus reconstruct Article 360 of the Criminal Law of our country.
