【摘要】：信息社會(huì)是人類社會(huì)發(fā)展與信息革命相耦合的必然結(jié)果,隨著信息化社會(huì)的發(fā)展,信息安全成為了影響國(guó)家安全的新重要因素。信息犯罪作為發(fā)生于信息空間中危害信息法益、威脅信息秩序應(yīng)受刑法處罰的數(shù)字化行為,具體可表現(xiàn)為侵入、劫持、破壞、傳播、假冒ID等五種形式。針對(duì)信息犯罪行為的特點(diǎn),應(yīng)在信息立法、執(zhí)法和司法過程中,加強(qiáng)ISP社會(huì)責(zé)任的認(rèn)定,確立利益主義為核心的司法管轄權(quán),加強(qiáng)信息犯罪偵查的專業(yè)化建設(shè),以此來(lái)全面維護(hù)國(guó)家信息安全。
[Abstract]:Information society is the inevitable result of the coupling of human social development and information revolution. With the development of the information society, information security has become a new important factor affecting national security. Information crime is a digital act that endangers information legal benefits in the information space and threatens the information order to be punished by criminal law. In the five forms of entry, hijacking, hijacking, destroying, spreading, and counterfeiting ID, we should strengthen the identification of the social responsibility of ISP in the process of information legislation, law enforcement and judicature, establish the jurisdiction of the interests as the core, and strengthen the professional construction of the investigation of information crime, so as to safeguard the national information security in an all-round way.
