【摘要】：牽連犯是刑法理論中構(gòu)造復(fù)雜、內(nèi)涵模糊、構(gòu)造奇特的一種犯罪形態(tài),由于涉及理論問題眾多而成為刑法理論中極富爭(zhēng)議的熱點(diǎn)問題,自產(chǎn)生以來經(jīng)歷了近兩個(gè)世紀(jì)的漫長(zhǎng)發(fā)展,學(xué)者們對(duì)牽連犯的相關(guān)理論研究也取得了階段性的成果。牽連犯作為一種客觀存在的特殊犯罪形態(tài),我國(guó)刑法分則雖然對(duì)此有所涉及,但由于未能明確牽連犯的具體內(nèi)涵,沒有確立統(tǒng)一的處斷原則,在司法實(shí)務(wù)中對(duì)于未明文規(guī)定的牽連犯的處斷顯得十分混亂,在刑法理論學(xué)界中更是眾說紛紜,難有定論,無論是牽連犯的概念還是特征及處斷原則不同學(xué)派都存在著諸多爭(zhēng)議。 牽連犯特殊的罪數(shù)本質(zhì)決定了對(duì)牽連犯的界定與處斷必須異于一般的單純一罪和一般的實(shí)質(zhì)數(shù)罪,這就要求我們必須準(zhǔn)確的劃定牽連犯的內(nèi)涵及外延,以便全面認(rèn)識(shí)把握牽連犯,在此基礎(chǔ)上尋求最為科學(xué)合理且符合法理的處斷原則。牽連犯涉及的刑法理論知識(shí)頗為艱深復(fù)雜,但最核心的問題就是牽連犯的認(rèn)定和處罰原則的選擇,本文將就圍繞牽連犯理論中這兩個(gè)最為基本的問題展開論述,通過歸納總結(jié)并深入評(píng)析國(guó)內(nèi)外不同學(xué)說,針對(duì)我國(guó)當(dāng)前的立法實(shí)際和司法困境,就牽連犯的罪數(shù)本質(zhì)和應(yīng)適用從一重重處罰原則的依據(jù)等觀點(diǎn)進(jìn)行詳盡的闡述。
[Abstract]:Implicated offense is a kind of criminal form with complicated structure, vague connotation and peculiar structure in the theory of criminal law. It has become a controversial hot issue in the theory of criminal law because of its numerous theoretical problems. After nearly two centuries of development, scholars have made some achievements in the theoretical research of implicated crime. As an objective and special form of crime, although the specific provisions of criminal law of our country are concerned with this, but because of the failure to make clear the specific connotation of implicated crime, we have not established a unified principle of adjudication. In the judicial practice, the conclusion of the unspecified implicated crime appears to be very confusing, and in the field of criminal law theory, there are many different opinions, which are difficult to come to a conclusion. There are many controversies in different schools of thought, whether it is the concept or characteristics of implicated offense and the principle of adjudication. The nature of the number of crimes in implicated crime determines that the definition and punishment of implicated crime must be different from that of simple crime and general substantial crime, which requires us to define the connotation and extension of implicated crime accurately. In order to fully understand and grasp the implicated crime, on this basis to seek the most scientific and reasonable and in accordance with the principle of adjudication. The knowledge of criminal law involved in implicated crime is very complicated, but the core problem is the identification of implicated crime and the choice of punishment principle. This paper will discuss the two most basic problems in implicated crime theory. Through summing up and deeply evaluating different theories at home and abroad and aiming at the current legislative practice and judicial dilemma in our country, this paper expounds in detail the essence of the number of crimes implicated and the basis for the application of the principle of heavy punishment.
