【摘要】：虛假訴訟行為在當今社會中層出不窮,歸根到底在于虛假訴訟行為的犯罪成本低,犯罪手段多樣化,隱蔽性極強。一些犯罪的發(fā)生往往是在利益的驅(qū)使下,進而鋌而走險,不惜通過不法途徑規(guī)避法律風險,謀取非法利益,他人的合法權(quán)益進而受到侵害。我國之前的《刑法》對虛假訴訟行為的處理模式是比照妨害司法罪的相關(guān)規(guī)定進行處理的。法律在這方面的立法不足使得虛假訴訟行為在法律適用上沒有明確的法律依據(jù),進而在對虛假訴訟行為進行刑法規(guī)制時不能真正的做到罪責刑相適應的原則。我國《刑法修正案(九)》出臺填補了這方面的空白,使得虛假訴訟行為真正做到了有法可依,對虛假訴訟行為能夠做到準確的定性,進而適用符合比例的刑罰處罰。各地在司法實踐中出現(xiàn)適用標準的不統(tǒng)一現(xiàn)象,嚴重阻礙了法律的具體貫徹和落實。本文以虛假訴訟行為入罪價值為切入點,通過對虛假訴訟罪的概念準確定義,到與其他相似概念的區(qū)分,對虛假訴訟的內(nèi)涵與外延有一個準確的定義。對虛假訴訟罪的類型的劃分主要依據(jù)三個標準:一是按犯罪對象的特點;二是按照行為手段的特點;三是,按照主觀心態(tài)的特點。其次,對虛假訴訟行為的特征進行研究,從本質(zhì)特征出發(fā)對虛假訴訟行為進行了比較深入的研究,對虛假訴訟行為具有的應罰性以及在司法實踐中適用的標準不統(tǒng)一等方面對虛假訴訟行為入罪的必要性進行研究,通過進一步剖析虛假訴訟罪的構(gòu)成要件明確了相關(guān)的概念,對"捏造的事實"、"提起民事訴訟"、對虛假訴訟是否包含"隱瞞真相"的相關(guān)討論,對這些定義在司法實踐有了準確的定性;對虛假訴訟罪的客體進行單一客體與復雜客體的相關(guān)討論,通過對虛假訴訟罪"罪"與"非罪"、"此罪與彼罪"的相關(guān)討論,使得虛假訴訟罪有了獨立成罪的價值。在"罪與非罪"中,首先,區(qū)分了虛假訴訟罪與民事訴訟中一般虛假行為,兩者的嚴重社會危險性不同,具有質(zhì)的區(qū)分。其次,虛假訴訟罪應為結(jié)果犯,只有對司法秩序造成嚴重的破壞和對他人的合法權(quán)益造成嚴重的損害時,虛假訴訟罪才能成立結(jié)果犯。對虛假訴訟罪停止形態(tài)中可能出現(xiàn)的各種停止形態(tài)進行了比較細致的分析、對虛假訴訟行為的共犯從案件中到案件外進行了比較系統(tǒng)的論證、對虛假訴訟行為出現(xiàn)的想象競合犯等罪數(shù)形態(tài)進行了相關(guān)討論,進而論證了虛假訴訟行為入罪價值的合理性。從而對虛假訴訟罪有一個明晰的界定,也能夠為研究虛假訴訟罪提供一個新的視角。
[Abstract]:In the present society, the false litigation behavior emerges in endlessly, in the final analysis, the crime cost is low, the crime means is diversified, the concealment is extremely strong. Some crimes are often driven by interests, and then take the risk, even through illegal ways to avoid legal risks, seek illegal interests, and then the legitimate rights and interests of others have been infringed. The former Criminal Law of our country dealt with the mode of dealing with the false litigation act in accordance with the relevant provisions of the crime of obstruction of justice. The lack of legislation in this respect makes the false litigation act in the application of the law has no clear legal basis, and then in the criminal law regulation of false litigation acts can not really achieve the principle of crime and punishment adapt to the principle. The introduction of the Criminal Law Amendment (9) fills up the blank in this respect, which makes the false litigation act have the legal basis, and the false litigation act can be qualified accurately, and then the corresponding punishment can be applied. The disunity of applicable standards in judicial practice has seriously hindered the implementation of the law. In this paper, through the accurate definition of the concept of the crime of false litigation and the distinction from other similar concepts, there is an accurate definition of the connotation and extension of the false litigation. The classification of the crime of false litigation is mainly based on three criteria: first, according to the characteristics of the object of crime; second, according to the characteristics of the means of conduct; third, according to the characteristics of subjective mentality. Secondly, the characteristics of the false litigation act are studied, and the nature of the false litigation act is studied deeply. This paper makes a study on the necessity of criminalizing false litigation from the aspects of the punishment of false litigation and the disunity of standards applied in judicial practice, and clarifies the relevant concepts by further analyzing the constitutive elements of the crime of false litigation. For "fabricated facts", "initiating civil proceedings", whether false litigation contains "concealing the truth" related discussion, these definitions in judicial practice has accurate qualitative; This paper discusses the single object and complex object of the crime of false litigation. By discussing the crime of false litigation "and" non-crime "and" this crime and that crime ", the crime of false litigation has the value of becoming an independent crime. In "crime and non-crime", first of all, the author distinguishes the crime of false litigation from the general false act in civil action. The two have different serious social danger and have a qualitative distinction. Secondly, the crime of false litigation should be committed as a result crime. Only if the judicial order is seriously damaged and the legitimate rights and interests of others are seriously damaged, can the crime of false litigation be established as a consequential crime. This paper makes a detailed analysis of the various forms of cessation that may occur in the form of cessation of false litigation, and demonstrates systematically the accomplices of false litigation from the case to the outside of the case. This paper discusses the number of crimes, such as imaginative concurrence crime, which appears in false litigation, and then proves the reasonableness of the incrimination value of false litigation. Thus a clear definition of the crime of false litigation can also provide a new perspective for the study of the crime of false litigation.
