【摘要】：警察央地分權(quán)面臨著國(guó)家治理體系與治理能力現(xiàn)代化推進(jìn)的挑戰(zhàn)和我國(guó)單一制下央地關(guān)系不斷發(fā)展變化的挑戰(zhàn),而現(xiàn)有法律對(duì)警察央地分權(quán)的規(guī)定不足、現(xiàn)行警察體制在央地分權(quán)上存在缺陷。厘清國(guó)家治理現(xiàn)代化進(jìn)程中的警察央地分權(quán)問(wèn)題,可以進(jìn)一步規(guī)范央地治理體系、提升治理能力,為解決中央與地方之間利益糾紛、矛盾沖突提供新思路與新方向,有利于促進(jìn)和保障國(guó)家的統(tǒng)一與穩(wěn)定。應(yīng)明確警察央地分權(quán)的價(jià)值目標(biāo)與原則以及內(nèi)容與界限等基本問(wèn)題,并從規(guī)范化警察央地分權(quán)相關(guān)法律依據(jù)、建立央地兩警分設(shè)機(jī)制、形成警察央地分權(quán)良性的互動(dòng)機(jī)制等方面進(jìn)行。
[Abstract]:The police central-land decentralization is facing the challenge of the modernization of the national governance system and governance capacity and the constant development of the relationship between the central and the local authorities under the single system of our country, but the existing laws do not provide for the separation of powers between the police and the central authorities. The present police system has defects in central-land decentralization. To clarify the problem of police central-land decentralization in the process of modernization of state governance, we can further standardize the central governance system, enhance governance capacity, and provide new ideas and new directions for resolving disputes of interests and conflicts between the central and local governments. It is conducive to promoting and safeguarding the unity and stability of the country. It is necessary to make clear the basic problems such as the value goal and principle, the content and the limit of the police central-land decentralization, and to establish a mechanism for the division of the two policemen from the legal basis of standardizing the police central-land decentralization. The formation of the police central division of power benign interactive mechanism and so on.
