黑社會性質(zhì)犯罪成因與對策

【摘要】： 本文分為二章。 第一章論述了我國當前黑社會性質(zhì)組織犯罪狀況，其中： 第一節(jié)主要從我國刑法第194條第一款來界定黑社會性質(zhì)組織，同時又根 據(jù)國際黑社會組織的特征，對照我國黑社會性質(zhì)犯罪組織的具體情況來解釋什 么是黑社會性質(zhì)組織，并且闡明了黑社會性質(zhì)組織的特征。 第二節(jié)主要說明了中國大陸現(xiàn)階段不存在嚴格意義上的黑社會，原因是中 國不存在黑社會的客觀社會條件，且中國境內(nèi)的犯罪形態(tài)還沒有發(fā)展到產(chǎn)生黑 社會的階段。 第三節(jié)探討了黑社會性質(zhì)犯罪產(chǎn)生的經(jīng)濟原因、社會原因和意識原因。 第四節(jié)、第五節(jié)分別探討了黑社會性質(zhì)犯罪的危害，并對黑社會性質(zhì)犯罪 的發(fā)展趨勢進行預(yù)測。 第二章 針對黑社會性質(zhì)犯罪案件的一般特點、成因，，提出了黑社會性質(zhì) 犯罪案件的對策，即預(yù)防對策和偵查對策，在預(yù)防對策中，提出了立法預(yù)防， 加大反腐力度和提高全民道德與法制素質(zhì)；在偵查對策中，對黑社會性質(zhì)犯罪 案件提出一整套的偵查思路，從反黑偵查的指導(dǎo)思想、原則、方針到反黑機構(gòu) 的建設(shè)、反黑情報工作、反黑偵查協(xié)作、秘密偵查措施以及關(guān)于黑社會性質(zhì)犯 罪案件中證人的保護，從而構(gòu)成了黑社會性質(zhì)犯罪案件偵查的完整體系。
[Abstract]:This paper is divided into two chapters. The first chapter discusses the current crime situation of the underworld organization in our country. The first section mainly defines the underworld nature organization from the first paragraph of Article 194 of the Criminal Law of our country. At the same time, according to the characteristics of international triad organizations, According to the concrete situation of the criminal organization of underworld nature in our country, it explains what is the underworld nature organization, and clarifies the characteristic of the underworld nature organization. The second section mainly explains that there are no triad societies in the strict sense in mainland China at this stage. The reason is that there are no objective social conditions for underworld societies in China. And the form of crime in China has not yet developed to the stage of black society. The third section discusses the economic reason, social reason and consciousness reason of the underworld crime. The fourth section, the fifth section discusses the harm of the underworld crime, and forecasts the development trend of the underworld crime. In the second chapter, according to the general characteristics and causes of the underworld crime cases, the author puts forward the countermeasures of the underworld crime cases, that is, the preventive countermeasures and the investigative countermeasures. In the preventive countermeasures, the author puts forward the legislative prevention, strengthens the anti-corruption efforts and improves the moral and legal quality of the whole people, and in the investigation countermeasures, To put forward a whole set of investigative ideas for criminal cases of the nature of the underworld, from the guiding ideology and principles of anti-criminal investigation, The guidelines include the building of anti-triad organizations, anti-triad intelligence work, and cooperation in anti-triad investigations, The secret investigation measures and the protection of the witnesses in the crime cases of the underworld nature constitute the complete system of the investigation of the criminal cases of the underworld nature.
