【摘要】： 社區(qū)矯正是相對(duì)于監(jiān)獄矯正而言的一個(gè)專門性術(shù)語(yǔ),它是西方國(guó)家民主意識(shí)、人道觀念、教育刑思想以及刑法經(jīng)濟(jì)化原則等現(xiàn)代行刑理念下的產(chǎn)物,社區(qū)矯正制度自20世紀(jì)在西方國(guó)家形成明顯趨勢(shì)和潮流。隨著我國(guó)行刑改革向縱深推進(jìn)速度的加快,社區(qū)矯正制度逐漸被引入并已開始試點(diǎn)工作,成為推動(dòng)我國(guó)行刑改革進(jìn)程的一個(gè)契機(jī)。從一開始,學(xué)界對(duì)如何推進(jìn)社區(qū)矯正工作也提出了許多好的建議和方法,對(duì)啟動(dòng)這項(xiàng)工作的序幕起到了重要作用,但國(guó)外理論模式如果缺乏對(duì)中國(guó)具體國(guó)情的關(guān)照,缺乏對(duì)自身運(yùn)行的內(nèi)在邏輯分析,這種理論就很難對(duì)現(xiàn)實(shí)具體環(huán)境產(chǎn)生有效的指導(dǎo)力。本文擬從社區(qū)矯正制度的發(fā)端、傳承以及現(xiàn)階段在我國(guó)的試點(diǎn)現(xiàn)狀為切入點(diǎn),深入分析在我國(guó)全面推行社區(qū)矯正制度的七大困境,并在此基礎(chǔ)上從宏觀變革和微觀機(jī)制推動(dòng)這兩個(gè)方面來采取相應(yīng)的辦法,以探索我國(guó)全面推行社區(qū)矯正制度的對(duì)策與出路。
[Abstract]:Community correction is a special term relative to prison correction. It is the product of modern execution concepts such as democratic consciousness, humane concept, educational punishment thought and economic principle of criminal law in western countries. Since 20th century, the community correction system has formed a clear trend and trend in western countries. With the speeding up of the execution reform in China, the community correction system has gradually been introduced and has begun to pilot work. It has become an opportunity to promote the process of execution reform in our country. From the beginning, scholars have also put forward many good suggestions and methods on how to promote the work of community correction, which has played an important role in starting the prelude to this work. However, if the foreign theoretical model lacks the care of China's specific national conditions and the internal logic analysis of its own operation, it will be difficult for this theory to produce effective guidance to the actual concrete environment. Based on the analysis of the seven predicaments of carrying out the community correction system in an all-round way in our country and the current status of the pilot project in our country at the present stage, and on the basis of this, the corresponding measures are taken from the macro reform and the micro mechanism to promote these two aspects. In order to explore the comprehensive implementation of community correction system in China and the way out.
