我國土地承包經(jīng)營權抵押融資的相關制度構建

【摘要】:改革開放以來,我國經(jīng)濟發(fā)展迅速,當前已發(fā)展成為世界第二大經(jīng)濟體,特別是國家在工業(yè)、科技事業(yè)上的發(fā)展更是有了質的飛躍。然而,農(nóng)村農(nóng)業(yè)的發(fā)展嚴重滯后,一直制約著我國由一個經(jīng)濟大國向經(jīng)濟強國的轉化。近年來,中央強調了這個方面,在各方民眾的支持下,一定要處理好三個核心問題,所以就發(fā)布了一些規(guī)定,要徹底的告別“三農(nóng)”問題。促進農(nóng)村經(jīng)濟的發(fā)展,提高農(nóng)民的生活水平,農(nóng)業(yè)發(fā)展的關鍵無非兩點,一是農(nóng)業(yè)資金的投入,二是農(nóng)村土地的利用,特別是農(nóng)民土地承包經(jīng)營權的利用。當前,我國正處于全面深化改革的階段,而農(nóng)村土地經(jīng)營權的抵押貸款的試點改革也全面展開。然而,基于理論和實踐的土地抵押貸款融資模式仍處于探索階段,尚未形成成熟的制度;谝酝难芯,結合相關理論和我國現(xiàn)狀,實際上再吸取國外研究經(jīng)驗,分析中國目前的土地抵押融資問題制度,并按照目前的原則,結合土地抵押融資創(chuàng)新,為農(nóng)村土地抵押融資制度創(chuàng)新提出了相關制度構想。本文除引言和結語外,分為五個部分:第一部分,介紹農(nóng)村土地承包經(jīng)營權抵押融資的相關概念;第二部分,對我國農(nóng)村土地承包經(jīng)營權的抵押融資實施的相關法律規(guī)定和政策的變革予以評述;第三部分,分析我國土地承包經(jīng)營權融資的試點現(xiàn)狀,并且探討農(nóng)村土地承包經(jīng)營權抵押實施中遭遇的困境和問題;第四部分,結合外國和臺灣地區(qū)的農(nóng)村土地按揭融資實踐,筆者在美國,德國,臺灣地區(qū)的這一部分作為對照和我國加入了一些介紹,具體的就是一些在實際里面的做法,希望可以為咱們國家的抵押主要是關于農(nóng)村土地方面的一些問題提供一點借鑒;第五部分提出了農(nóng)村土地承包履行法定制度等抵押融資權的措施,確認了農(nóng)村土地抵押制度的合同管理;完善中國土地登記制度的承包權;完善承包土地流轉監(jiān)督機制;完善中國農(nóng)村社會保障制度;完善我國農(nóng)村土地糾紛解決機制;建立中國市場土地流轉合同經(jīng)營權支持體系;制度上要搞好完善,農(nóng)村土地承包經(jīng)營很是重要,另一個就是要提高一下評估體系的時評能力,當然是指土地承包經(jīng)營權上的一個價值,最后一個就是一個流通模式要謹慎的完善,這個很重要,是關鍵,要做好強化,為實施農(nóng)村土地承包經(jīng)營權抵押融資提供依據(jù)。
[Abstract]:Since the reform and opening up, China's economy has developed rapidly, and has developed into the second largest economy in the world, especially the development of the country in industry, science and technology has made a qualitative leap forward. However, the development of rural agriculture lags behind seriously, which restricts the transformation from a large economic country to an economic power. In recent years, the Central Committee has emphasized this aspect. With the support of the people of all quarters, we must deal with the three core issues, so we have issued some regulations to bid farewell to the issue of "agriculture, countryside and farmers." To promote the development of rural economy and improve the living standard of farmers, the key to agricultural development is the input of agricultural funds and the utilization of rural land, especially the use of farmers' right to contract and manage land. At present, our country is in the stage of comprehensive deepening reform, and the pilot reform of mortgage loan of rural land management right is also carried out in an all-round way. However, the land mortgage financing model based on theory and practice is still in the exploratory stage and has not yet formed a mature system. Based on the previous research, combined with the relevant theories and the present situation of our country, and drawing on the foreign research experience, this paper analyzes the current system of land mortgage financing in China, and according to the current principles, combining with the innovation of land mortgage financing, For the rural land mortgage financing system innovation, put forward the related system concept. In addition to the introduction and conclusion, this paper is divided into five parts: the first part introduces the related concepts of the rural land contractual management right mortgage financing; the second part, This paper reviews the relevant legal provisions and policy changes in the implementation of mortgage financing of rural land contractual management right in China. The third part analyzes the status quo of the pilot projects of land contractual management right financing in China. And discusses the difficulties and problems encountered in the implementation of rural land contractual management right mortgage. Part IV, combining with the foreign and Taiwan rural land mortgage financing practice, the author in the United States, Germany, This part of the Taiwan area as a comparison with our country joined some introduction, specific is some in the actual practice, hoping to provide some reference for our country's mortgage is mainly about the rural land aspects of some issues; The fifth part puts forward the measures of the right of mortgage financing, such as carrying out the legal system of the rural land contract, confirming the contract management of the rural land mortgage system, perfecting the contract right of the land registration system in China, perfecting the supervision mechanism of the contracted land circulation; To perfect China's rural social security system, to perfect the rural land dispute resolution mechanism in China, to establish a supporting system for the contractual management of land circulation in the Chinese market, and to improve the system, it is very important for rural land to be contracted and operated. The other is to improve the current evaluation capability of the evaluation system. Of course, it refers to a value in the right to contract land management. The last one is that a circulation model should be carefully improved. This is very important, it is the key, and we must do a good job of strengthening it.
