【摘要】：我國立法和相關(guān)政策從制度規(guī)范的角度否定了人口增減原因的農(nóng)地調(diào)整,并將調(diào)整范圍限定在狹義的法定情形之中。農(nóng)地調(diào)整作為公權(quán)力涉入私法的一項(xiàng)衡平工具,在公平分配和保障農(nóng)地基本利用效率上具有不同的規(guī)范路徑。從歷史實(shí)證的角度考察,農(nóng)地調(diào)整制度的"廢除"應(yīng)解釋為一項(xiàng)"表面共識(shí)",即"增人不增地、減人不減地"政策為完成其村莊治理目標(biāo)的附屬產(chǎn)物。在當(dāng)前的社會(huì)實(shí)證考察中,農(nóng)地調(diào)整仍然存在實(shí)踐需求,其內(nèi)含的制度意蘊(yùn)無法借助法定調(diào)整模式實(shí)現(xiàn),在三輪承包時(shí)采取適當(dāng)調(diào)整承包期限、對(duì)新增人口予以經(jīng)濟(jì)補(bǔ)償或其他"可替代性保障"的法技術(shù)手段仍然具有現(xiàn)實(shí)意義。而立足于規(guī)范實(shí)證,針對(duì)集體決議借助農(nóng)地調(diào)整介入私法領(lǐng)域的行為,調(diào)整制度還承擔(dān)著保持最小耕種單位以及特殊情形下整合土地規(guī)模等功能,且應(yīng)當(dāng)在未來中國《民法典》中予以補(bǔ)充規(guī)范。不同的實(shí)證考察視角,可厘清中國農(nóng)地調(diào)整理論與現(xiàn)實(shí)之間的沖突,進(jìn)而在現(xiàn)行制度框架下采納"可替代性保障"和"對(duì)既有用益物權(quán)進(jìn)行調(diào)整"的雙向路徑,更妥適地實(shí)現(xiàn)公平與效率的農(nóng)地價(jià)值目標(biāo)。
[Abstract]:The legislation and related policies of our country negate the adjustment of farmland because of the increase and decrease of population from the point of view of system norm, and limit the scope of adjustment to the legal situation in a narrow sense. As an equitable tool of public power involved in private law, farmland adjustment has different normative paths in the fair distribution and protection of the basic utilization efficiency of agricultural land. From the perspective of historical demonstration, the abrogation of farmland adjustment system should be interpreted as a "superficial consensus", that is, the policy of "increasing people not increasing land, reducing people not reducing land" is the subsidiary product of accomplishing the goal of village governance. In the current social demonstration investigation, the farmland adjustment still has the practical demand, the system implication contained therein cannot be realized by the legal adjustment mode, and the appropriate adjustment time limit should be adopted in the three rounds of contracting. It is still of practical significance to provide economic compensation or other "alternative safeguard" to the new population. On the basis of normative demonstration, in view of the collective decision to intervene in the field of private law with the aid of the collective resolution, the adjustment system also undertakes the functions of keeping the minimum farming unit and integrating the land scale under special circumstances. And it should be supplemented in the Civil Code of China in the future. From different perspective of empirical investigation, we can clarify the conflict between the theory and reality of agricultural land adjustment in China, and then adopt the two-way path of "alternative safeguard" and "Adjustment of existing usufruct right" under the framework of current system. The goal of fair and efficient farmland value should be realized more appropriately.
