【摘要】:近些年來,在農(nóng)業(yè)稅已取消多年的同時(shí),伴隨國(guó)家大量“三農(nóng)”政策的頻繁頒布,農(nóng)村土地的價(jià)值獲得了極大的提升,在此環(huán)境之下,農(nóng)業(yè)也迎來越來越多的開發(fā)機(jī)遇。因此在用地需求方面,農(nóng)業(yè)經(jīng)營(yíng)組織用地也呈現(xiàn)出多樣性和擴(kuò)張性的特點(diǎn),亟需足夠的土地用以滿足集約化、規(guī);、高效化以及產(chǎn)業(yè)化的經(jīng)營(yíng)需求,在這一系列因素主導(dǎo)下,土地流轉(zhuǎn)日益凸顯出其重要性與迫切性。與此同時(shí),政府方面對(duì)三農(nóng)問題也保持了持續(xù)的關(guān)注,反復(fù)要求對(duì)農(nóng)村改革予以深化落實(shí),保障當(dāng)前土地關(guān)系的持久性與穩(wěn)定性。構(gòu)建完善土地承包及流轉(zhuǎn)市場(chǎng),保證農(nóng)業(yè)生產(chǎn)要素配制的高效性及流轉(zhuǎn)的合理性,業(yè)已成為我國(guó)農(nóng)業(yè)不斷實(shí)現(xiàn)現(xiàn)代化過程中的一個(gè)重要難題,同時(shí)也是推動(dòng)城鎮(zhèn)化步伐、加快工業(yè)化進(jìn)程的不二之途。在當(dāng)前態(tài)勢(shì)下,我們只有將農(nóng)村土地承包經(jīng)營(yíng)權(quán)視為一項(xiàng)財(cái)產(chǎn),融入到市場(chǎng)流通的大潮中,實(shí)現(xiàn)交換價(jià)值,愈為緊密地將土地與農(nóng)民的切身利益聯(lián)系起來,這也是確保土地資源獲得維護(hù)的前提,是保證社會(huì)主義新農(nóng)村建設(shè)中農(nóng)民主體作用的題中之義,進(jìn)而實(shí)現(xiàn)深入解放與發(fā)展生產(chǎn)力,促進(jìn)土地資源配置得到優(yōu)化的目標(biāo)。在本文中,筆者遵循以下研究框架:第一部分:緒論。在緒論中,筆者重點(diǎn)論述了本文的研究背景和意義,對(duì)論文的研究方式與技術(shù)渠道進(jìn)行了說明。第二部分:文獻(xiàn)綜述及基礎(chǔ)理論,論文有關(guān)的理論及概念進(jìn)行了分析,重點(diǎn)探析了國(guó)內(nèi)與海外的研究狀況。第三部分:分析了源城區(qū)農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的現(xiàn)實(shí)狀況,對(duì)該區(qū)域經(jīng)營(yíng)權(quán)流轉(zhuǎn)的構(gòu)成、當(dāng)前狀況和供求特征進(jìn)行了探索。第四部分:對(duì)經(jīng)營(yíng)權(quán)流轉(zhuǎn)當(dāng)前所遇到的困境與形成原因做出了闡述和分析。第五部分:通過闡述國(guó)內(nèi)外農(nóng)村土地流轉(zhuǎn)的相關(guān)狀況,分析了可用于借鑒的寶貴經(jīng)驗(yàn)和啟示。最后一個(gè)部分:給予健全機(jī)制、培養(yǎng)主體、推動(dòng)轉(zhuǎn)變等環(huán)節(jié)和步驟,提出了推動(dòng)源城區(qū)農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的相關(guān)建議與策略。
[Abstract]:In recent years, agricultural tax has been abolished for many years, along with the frequent promulgation of a large number of "three rural" policies, the value of rural land has been greatly improved, in this environment, agriculture also ushered in more opportunities for development. Therefore, in the aspect of land demand, the land used by agricultural management organizations also presents the characteristics of diversity and expansibility. It is urgent to use enough land to meet the needs of intensive, large-scale, efficient and industrialized management. Land circulation increasingly highlights its importance and urgency. At the same time, the government has paid more and more attention to the issue of agriculture, rural areas and farmers, and repeatedly demanded that the rural reform be deepened and implemented so as to ensure the durability and stability of the current land relations. To construct and perfect the land contract and circulation market, to ensure the high efficiency and rationality of agricultural production factor preparation, has become an important problem in the process of agricultural modernization in our country, and at the same time, it is also to promote the pace of urbanization. Speed up the industrialization process of the road. Under the current situation, we can only regard the contracted management right of rural land as a property, integrate it into the tide of market circulation, realize the exchange value, and more closely link the land with the vital interests of the peasants. This is also the premise of ensuring the maintenance of land resources and the meaning of the main role of farmers in the construction of new socialist countryside, thus realizing the goal of further emancipating and developing productive forces and promoting the optimization of land resources allocation. In this paper, the author follows the following research framework: the first part: introduction. In the introduction, the author focuses on the research background and significance of this paper, and explains the research methods and technical channels. The second part: literature review and basic theory, related theories and concepts are analyzed, focusing on the domestic and overseas research situation. The third part analyzes the real situation of the transfer of rural land contractual management right in Yuancheng District, and probes into the composition, current situation and supply and demand characteristics of the circulation of management right in this area. The fourth part expounds and analyzes the predicament and formation reason of management right circulation. The fifth part: through expounding the related situation of rural land circulation at home and abroad, it analyzes the valuable experience and enlightenment that can be used for reference. The last part: give the perfect mechanism, train the main body, promote the transformation and other links and steps, put forward the relevant suggestions and strategies to promote the transfer of rural land contractual management right.
